Classification of drivers by categories of law. Grade allowance - cases and payment procedure

Car driver class.

Car driver class- this is his qualification characteristic, depending on the open categories in the driver's license and work experience.

Car driver class established by the Qualification Directory of Workers' Professions, which establish monthly salaries "(approved by the Decree of the State Committee of Labor of the USSR, All-Union Central Council of Trade Unions of 20.02.1984 n 58 / 3-102).

The validity of the reference book in the Russian Federation is confirmed by the resolution of the Ministry of Labor of the Russian Federation of May 12, 1992 N 15a "On the application of the current qualification reference books of work, professions of workers and positions of employees at enterprises and organizations located in Russia."

2. Grounds for conferring a class.

driver class 3 is the presence of a driver's license with open categories of vehicles "B" and (or) "C", or one category "D". Such categories are obtained during primary vocational training.

Basis for qualification driver class 2 is the presence of a driver's license with open categories "B", "C" and "E" or "D" ("D" and "E"). Continuous work experience must be at least three years as a driver of a class 3 car in this enterprise.
Basis for qualification 1st class driver is the presence of a driver's license with open categories "B", "C", "E" and "D". Continuous work experience must be at least two years as a driver of a class 2 car in this enterprise.
In addition to the requirements provided for by the qualification characteristics, for the assignment of qualifications second and first class car drivers must have good performance in work (systematically fulfill plans, transportation schedules and traffic schedules, not have excessive consumption of fuel against the established norms), observe labor and production discipline: not have violations of traffic rules that have entailed road traffic violations in the last three years of work. -traffic accidents or revocation of a driver's license, as well as violations during the last year of the rules of technical operation, safety rules and work instructions.

3. The order of assignment of class.

Driver qualification class 3 can be assigned at the first hiring, while writing a statement of the following content “I ask you to hire me as a class 3 driver to drive cars according to the open category B (you can drive a gazelle and a car), or“ I ask you to hire me as a class 3 driver for driving cars in accordance with open categories B and C or "I ask you to hire me as a driver of the 3rd class for driving cars (buses) in accordance with open category D". But there may be a hiring of a car as a driver without specifying a class (for example, an employer has only one car). Or the employer does not pay a class premium and, in principle, does not want to apply the class assignment (even the driver's qualifications of class 3).

The qualification of a driver of classes 2 and 1 is assigned in the course of work by the qualification commission of a transport company, workshop or other subject of transport activity. This is provided that the employer applies a system of advanced training for car drivers and pays for the 2nd and 1st class.

4. Grade supplement.

4.1. As it was. Previously, the Resolution of the Central Committee of the CPSU, the Council of Ministers of the USSR and the All-Union Central Council of Trade Unions of the USSR and the All-Union Central Council of Trade Unions of the Soviet Union and All-Union Central Council of Trade Unions of 17 September 1986, No. 1115 "On improving the organization of wages and the introduction of new tariff rates and official salaries of workers in the industrial sectors of the national economy."

According to Appendix No. 21 of this decree, drivers of trucks and cars, buses were paid a monthly premium for class in the following amounts: drivers of the 2nd class - 10 percent and drivers of the 1st class - 25 percent of the established tariff rate for the time worked as a driver. Resolution of September 17, 1986 N 1115 is currently advisory in nature.

4.2. How it became. Various regulatory documents have now canceled the mandatory nature of the payment of additional payments for class to car drivers. Employers have the right to independently establish premiums for the class of drivers of trucks, cars and buses.

Additional payments for grades 2 and 1 are made if they are established by collective agreements of enterprises, regulations for individual departments (ministries), local regulations (provisions on remuneration and material incentives for employees).

The assignment of class to drivers in various organizations has been practiced since the days of the USSR. Classiness gives the driver the right to receive a certain salary supplement.

Driver class by category

In 2018, as before, the assignment of class to drivers in the Russian Federation is regulated by the Qualification Directory of Workers' Professions, approved by the decree of the State Committee for Labor of the USSR, the All-Union Central Council of Trade Unions of Russia dated 20.02.1984 No. 58 / 3-102, which sets monthly salaries (hereinafter referred to as the Directory) related to driving class performance is still in force, as the relevant professional standards have not yet been developed.

Another Soviet document states that drivers can be assigned 3 classes, they depend on the categories of a particular driver and the duration of work in one place.

When applying for a job, the class is assigned on the basis of a driver's license:

  • 1st class driver - gets a specialist with categories B, C, D, E.
  • Grade 2 - categories B, C, E or D and E (that is, there are two options for combining categories).
  • Grade 3 - categories B, C or only one category D.

In the process of further work in the company, the increase in categories depends on how long a person has been working in it.

Assigning class to drivers

The conditions under which there is an increase or decrease in the class established upon hiring are spelled out in the Handbook, at the same time the Industry Agreement on Road and Urban Land Transport, which is currently extended until 2019 (hereinafter referred to as the Agreement), has an indication that the enterprise must develop its own local certificate of excellence.

The procedure for assigning a class to drivers at the enterprise

At the employer, the class of the driver's staff is increased by a special commission, which is approved by order of the management. In its work, the commission uses the Directory and internal documents, for example, the Classification Regulations, which determine what determines the driver's class.

Accordingly, the increase occurs:

  • from grade 3 to grade 2;
  • from class 2 to 1.

A driver of the 3rd class can improve him on condition of continuous three-year work in this position.

A class 2 driver is eligible for an upgrade if he has been employed for at least 2 years. Accordingly, having completed this period in one place, he will receive the status of a 1st class driver. What categories are open in his rights will no longer matter.

Downgrade

A decrease in a previously established class is possible in the following cases:

  • regular violation of labor discipline, traffic rules and machine operating rules;
  • failure to comply with the requirements that are spelled out in the Handbook for the established driver's class;
  • employment for a new job. In this case, the class is assigned again, according to the rights.

For example, a dismissed employee has only categories B and C, but due to the length of service he had the position of a driver of the 1st class. The requirements of the Handbook indicate that he can only get a job as a driver of the 3rd class at the next place of work.

How the class is paid for drivers in Russia

The assignment of a driver's class allows you to receive various wage supplements. The agreement prescribes the following allowances:

  • For class 1 - 25% of the salary or other tariff unit;
  • For class 2 - 10% of the salary or tariff unit;
  • There is no additional payment for the 3rd class.

The premium for the class of drivers can be set by the employer at its discretion, but at the same time, if he has not provided a written refusal to participate in the Agreement within 30 days, then it cannot be less than the one set in this document (25% and 10% respectively). This is established by the letter of the Ministry of Health and Social Development No. 338-TG dated 24.07.08.

Accordingly, the additional payment for the class of drivers must be equal to or greater than that established in the Agreement.

Also, the above document establishes that employers who decide to pay their drivers for class must develop the following documents:

  • Regulation on the assignment of class;
  • Classroom surcharge regulations.

The accrual of such an additive to drivers is established by an order for the organization.

Is it obligatory to establish the class of drivers by category

The company's management may well not assign a class to its employees, the legislation does not force them to do so. Accordingly, the additional payment for the class is not obligatory for drivers. In this case, a person is simply accepted for the position of a driver.

The qualification reference book of workers' professions, which are assigned monthly salaries, regulates how to obtain a driver's class, the conditions and procedure for its increase when working for one employer. If a company nevertheless assigns a class to its drivers, it must also calculate premiums for it.

With the rise in prices for compulsory motor third party liability insurance, many motorists shy away from issuing a policy. Such a decision cannot be called deliberate, although the desire to save is understandable. There is another, legal way to reduce the cost of the policy - accident-free driving. In this case, the driver class is assigned. How to define and use it correctly, read on.

Prerequisites

Today, such a concept as "driver's class" is most used by "seasoned specialists" who worked in the Soviet Union. Then the gradation began. Each driver sought to obtain a category 1 license. For this, a salary bonus was introduced by a resolution of the State Committee for Labor. The enterprise was also proud of its leaders. Today, there is no longer such a mandatory gradation. But if the director introduced it at the enterprise, then he can no longer cancel it. This is spelled out in clause 3.8 of the "Federal Agreement on Road and Land Transport".

Grouping

How to determine the driver's class according to the old scheme? There were only three of them and they were ranked from largest to smallest. The division was based on the number of open categories in the rights:

  • "A" - motorcycle transport;
  • "B" - a passenger car;
  • "C" - freight transport;
  • "D" - bus;
  • "CE" - heavy transport with a trailer.

How to determine the driver's class?

Grade 3

This group included drivers who had open categories "B" and "C". There was one more gradation. Instead of "C", "D" could have been opened.

2nd grade

Category B rights are not required for this group. In this case, it was necessary to have a permit to drive a bus ("D") and heavy vehicles with a trailer ("CE"). Acceptable conditions are “B + C + CE” or “B + C + D” or “D + CE”. The rights of this category were issued after three years of continuous driving.

1 class

The leaders were people who had all categories open. Although it was noted that the presence of a permit to drive motor vehicles is not required. As in the previous case, the rights of the first category were issued after two years of continuous driving of a truck.

Changes

This gradation has been used in the past. How to determine the class of the driver today? The process became more complicated as new categories appeared in the document:

  • "BE" - a passenger car with a trailer;
  • "CE" - a truck with a trailer;
  • "DE" - a bus with a trailer.

Classification for OSAGO

"Avtograzhdanka" includes a certain list of classes. There are only 13 of them. There is a minimum class among admitted drivers. How do you define it? If the driver does not have an insurance history as such, then the value "1" is assigned to him by default. This means that when calculating the cost of the policy, all factors were taken into account, except for driving history. With a decrease in the number of calls to the company for payments for the year, the driver's class is constantly increasing.

In parallel, the MSC indicator is calculated. It can help you reduce your annual fees by 5%. The person who is assigned the highest category "13" can receive a 50% discount when paying for the policy. Getting into an accident causes an increase in the price of the policy and a decrease in the class.

Drivers who have been assigned the lowest class (M) purchase a policy with a 45% flat rate markup. This situation occurs if a person has applied for payments to the company more than four times a year.

Policy cost

When calculating the cost of the policy, the driver's class has a decisive role. How to define it will be discussed in detail below. The essence of the calculations is as follows: the higher the class, the lower the price. The cost of the policy is determined based on four factors. Let's consider them in more detail.

Vehicle type

Tariffs are spelled out separately for buses, trucks and cars. Separately, there is a division by brands and models of vehicles based on the statistics of their accidents. Regional odds are based on incident data in all cities. Novice drivers are assigned the highest rate, while experienced drivers are assigned a lower rate.

Driving history

Based on this indicator, the MSC value is calculated. As mentioned earlier, the "bonus-malus" ratio affects the cost of the policy.

Driver class

On which site can you determine the class of the driver of the MTPL? PCA. Here is a special form for calculation. You must enter personal data (full name, date of birth) and certificate number. In response to the request, all information on the driver, that is, his insurance history, will appear. This information is used not only by consumers of services, but also by insurers. The story of a specific person can be found even if he changed his last name. Every insurance company has a similar database.

All companies, when signing a contract with a client, must enter his data into the PCA database. It does not matter whether this person was previously a client of the company or not. Insurance history is formed according to data from all insurers. This is spelled out in Art. 9 ФЗ № 40 "On OSAGO".

How to determine the driver's class for insurance through the website? If a person applies for a policy for the first time, then first all information is entered on the insurers' website. If he subsequently applies for payment, then the information is corrected. Data on the nature of the damage and the amount of the payment are entered. Even if after a while a person turns to another company, all information about him is saved. The new insurer will check the entire history in the PCA database. Here's how to determine the class of a driver for MTPL according to PCA data.

Checks

Any driver can also check information about himself on the insurer's website. This must be done annually when buying a policy. When calculating the cost of the policy, it is impossible to exclude the factor of human error. The contract specifies the sequence of payments. If discrepancies are found, you should contact the company to obtain a decryption. Typically, this situation occurs when changing insurers. If they refuse to carry out detailed calculations, you will have to contact the prosecutor's office.

Statement of claim

To appeal the cost of the policy, you need to submit a statement in which you indicate:

  • the essence of the claim is a listing of violated rights;
  • a detailed description of the circumstances;
  • a request to take action against the insurer and initiate proceedings against officials;
  • Personal Information.

Documents are reviewed within a month. Usually, after such a procedure, the company makes all the calculations.

KBM

Previously, KBM was calculated separately for each vehicle and reset to zero if it was sold. Accordingly, the discount on the purchase of the policy was reduced. The person who bought a new car had to collect points again and upgrade the class again. Since 2016, the calculation method has changed. The coefficient is assigned to the person himself, not to the car.

You can also find out the KBM how to determine the driver's accident-free class. Option one is to view information on the PCA website. Option two - look at the table below.

Class at the beginning of the year

Year end class (*)

* If a driver has applied for a payment once in a year, then for the next year his class will be the same as indicated in brackets.

How to determine the class of the car driver at the end of the year? It is necessary to find in the table the value of the category that was assigned to the driver at the beginning of the year and compare it with the number of requests for payments. An experienced driver is assigned the highest class "13" and receives a 50% discount (KBM = 0.5) on the purchase of a policy. How to determine the driver's class at the beginning of the year? It is equal to the number of years of driving experience.

Example

The insurance company assigned the driver a class "5" of accident-free driving and sold the policy with a 10% discount (KBM 0.9). If during the year, while the policy is valid, the driver applies for a payment, then the next time he will be assigned a class "3". If during the reporting period there are no calls to the company, it will be assigned a "6" class with MSC 0.85. That is, he will be able to buy a policy with a 15% discount.

Subspecies of KBM

Insurers divide this ratio into three more types:

  • driver's license - determined for each driver at the time of insurance;
  • vehicle owner;
  • estimated is used in costing.

There is also a maximum and minimum value of the indicator. The first one provides a discount on the purchase of the policy. At the minimum value, the policy is sold for 100% of its value. With a further decrease, the cost of the policy rises.

Application

Applies to compulsory and unrestricted in different ways. The first category includes contracts according to which the number of persons allowed to drive a car is limited. Accordingly, no limits are set in the policies of the second category.

The coefficient is determined for each driver separately. The calculation uses an indicator taking into account information on all drivers. Let's say the driver retains the driving class for the current year. The discount will be provided not to the owner, but to a specific driver. If the owner of the car changes within a year, the MSC will not be recalculated. The increase in the value of MSC for the next year will be carried out in relation to those persons who became the perpetrators of road accidents.

Cost calculation

The calculation is carried out according to this algorithm. At the first receipt of the policy, the driver is assigned the third class. If during the year there was not a single accident with his participation, then next year the class will be increased. If there was one request for payment, then the category will remain the same. If there were two or more hits, the class is reduced to "M". With each increase in the category, the MSC class decreases. The discount grows accordingly. For example, when switching to class "4", the driver is assigned a KBM of 0.95, which means the right to receive a 5% discount.

Factors

KBM directly depends on trouble-free driving. The assignment of the coefficient is carried out according to the OSAGO policy, which expired a year ago. Existing contracts are not taken into account. That is, if it is not possible to calculate the driver's MSC, it is assigned class "1" by default.

The experience of the driver also matters. The owner of the vehicle and the persons allowed to drive will be considered separately. The class is recalculated at the moment when it is necessary to make payments for accidents in which the driver is guilty. At the same time, the discount on the purchase of the policy is reduced even if the client has changed the insurance company.

Reflection of information in the policy

According to the law, it is not required to enter the data of the driver's and owner's MSC into the policy. But the insurer can do this on the basis of an internal order from the management. Usually, such information is written opposite the full name. the owner of the car and each authorized driver. Sometimes the entry is made in the column "Special marks".

Output

Designed with a reward system for experienced and accurate drivers. With great experience and correct driving, the client receives a 50% discount on the purchase of the policy. When making calculations, drivers are divided into certain categories. How to determine the minimum driver class? Taking into account the number of requests for payments and driving history, you can view the corresponding indicator on the PCA website or in a special table.

Quite often, when hiring a motor transport company, employees already have seniority and work experience. Some drivers are awesome. In this regard, the employers of transport companies have various questions related specifically to the class of the driver. For example, how is the class established, can it be downgraded, are they obliged to pay premiums for it? In this article, we will answer these questions.

For the first time, the class of vehicle drivers was envisaged by the Decree of the State Committee for Labor and the All-Union Central Council of Trade Unions of 17.08.1976 N 235/18. Later, this document became invalid, but the Qualification Directory of Workers' Professions, which sets monthly salaries (hereinafter referred to as the Directory), approved by the Decree of the USSR State Committee of Labor, All-Union Central Council of Trade Unions of Russia dated 20.02.1984 N 58 / 3-102, established the qualification characteristics of drivers of a certain class. In particular, all drivers who were trained and received a driver's license with permitted categories B or C or only D, drivers of the 2nd class - B, C, E or only D (D or E), and a driver of the 1st class - B, C, D and E. Moreover, the qualification of the 2nd class is awarded with continuous work experience of at least three years as a driver of a 3rd class car at a given transport company, and the 1st class is assigned with continuous work experience of at least two years as a 2nd class driver at this enterprise.
Assigning a class to drivers allows you to set various incentive supplements to wages. In accordance with the provisions of Art. 135 of the Labor Code of the Russian Federation, the remuneration system, including the size of tariff rates, official salaries, additional payments and allowances of a compensatory nature, a system of additional payments and allowances of a stimulating nature and a bonus system, are established by collective agreements, agreements, local regulations in accordance with labor legislation and other regulatory legal acts containing labor law norms. Moreover, local regulations establishing wage systems are adopted by the employer, taking into account the opinion of the representative body of employees.
When developing local regulations (regulations on remuneration and material incentives for employees), the employer independently determines the amount of the premium for the class of drivers. But it must be at least defined in clause 3.8 of the Federal Sectoral Agreement on Automobile and Urban Land Passenger Transport for 2008 - 2010 (registered on March 25, 2008 N 96 / 08-10 * (1)). In organizations of urban land passenger transport, taking into account the established practice, employers, in agreement with the relevant trade union committees, may establish a premium for class:
- to drivers of the 1st class in the amount of 25%;
- 2nd class drivers - 10% of the established tariff rate for the time worked as a driver.
It is necessary to adhere to this agreement by virtue of the Letter of the Ministry of Health and Social Development of the Russian Federation of July 24, 2008 N 338-TG, which draws attention to the fact that if within 30 calendar days from the date of the official publication of the proposal to join this agreement in the Ministry of Health and Social Development of the Russian Federation by employers who did not participate in the conclusion of the agreement, will not be presented in the established part 8 of Art. 48 of the Labor Code of the Russian Federation, a motivated written refusal to join the agreement, then the agreement will be considered extended to these employers. If the employer decides to introduce a grade premium, then the amount smaller than that specified in the sectoral agreement will not be able to establish.
It turns out that the employer may or may not introduce a grade premium. If a driver with 1st class gets a job at a transport company, then it is invalid at the new place of work. At the same time, the employer, at its discretion, can confirm the class of the driver upon admission in the order, and in this case the class remains.
The class can not only be established, but also downgraded (clause 7 of the Handbook), if the driver of the 1st or 2nd class:
- does not fulfill the requirements stipulated by the qualification characteristics or job description;
- systematically fails to fulfill plans, transportation schedules and traffic schedules;
- has excessive consumption of fuel;
- has over the last three years of work violations of traffic rules, resulting in road traffic accidents;
- violates the technical operation of the vehicle and safety regulations.
The downgrade of the qualification class is announced by the order of the head with the entry into the work book. Drivers who have a downgraded qualification class, as well as drivers who have been deprived of the right to drive a vehicle for a period of more than a year, the qualification class can be assigned again on a general basis.
To establish the procedure for assigning classes to drivers, an employer needs to develop a number of local regulations, because there are no mandatory requirements for assigning a class to the Labor Code of the Russian Federation and regulatory documents containing labor law norms. To do this, you need to create a qualification commission and ensure its functioning, as well as develop a regulation on the calculation of a premium for the class of drivers and a regulation on assigning a class to drivers - these conditions are necessary for the payment of the premium.
To resolve issues on the assignment (reduction) of the qualification level (class), a qualification commission is created at the motor transport enterprise, chaired by the head of the organization (license holder) or another person appointed by the relevant order. The composition and powers of the commission can be approved by order or decree of the head of the organization. Let's give an example.

Order N 28

- Kalmykov Roman Gennadievich, chief mechanic;
- Malyshev Andrey Alekseevich, driver-instructor for traffic safety.
2. Submit the lists of drivers subject to qualification certification, once a year no later than July 15 - to the head of the personnel department Petrova OI.
3. To organize the methodological preparation of qualification certification - to the head of the personnel department Petrova OI.
4. Submit materials of qualification certification to the director within 20 working days from the date of the minutes of the meeting of the commission - to the chairman of the commission.

Director Kalmykov / D.V. Kalmykov /

To obtain a class, a driver can write an application and attach to it a representation of his immediate supervisor or another employee on his behalf. In the submission, an assessment of the employee's activity, his business and moral qualities is given, the length of service is indicated and a proposal is made to assign a certain class.
When making a submission, it reflects: the name of the department, the name of the type of document, date, registration number (if the document is registered), addressee, title to the text, signature. If necessary, the submissions are endorsed by interested parties. Further, this document is signed by the compiler and addressed to the head of the organization.

Chairman of the Commission Ivanov I.I. Ivanov

Secretary of the Commission A.I.Sidorova Sidorova

Members of the Petrov Commission / O. I. Petrova /
Kalmykov / R.G. Kalmykov /
Malyshev / A.A. Malyshev /
I have read the minutes of the meeting of the qualification commission
Ermolaev / P.S. Ermolaev /, 17.08.2009.

After assigning a qualification class, you must also enter information about this in section. 4 personal cards (form T-2) and work book.
The driver's class has been assigned, and the accounting department has questions, for example, is it necessary to take into account the class premium when calculating the bonus? We answer: there is no official list of surcharges and surcharges to the tariff rates on which the bonus is accrued, labor legislation has not established. Previously, the Order of the Ministry of Transport of the RSFSR of 03/30/1987 N 44 "On the introduction of temporary instructions and recommendations for ensuring the performance of flights on bus routes" was in force, in clause 1.3 of which it was stated that the amount of bonuses was set by motor transport enterprises as a percentage of the wages of drivers at tariff rates for the time worked on the route, taking into account the allowances for class, additional payments for work divided into two parts (according to a discontinuous schedule), for the leadership of the brigade, for work at night. In connection with the adoption of the Labor Code of the Russian Federation, this document is applied in the part that does not contradict it. We repeat that Part 2 of Art. 135 of the Labor Code of the Russian Federation allows the employer to independently establish bonus systems by collective agreements, agreements, local regulations in accordance with labor legislation. Since the bonus is designed to materially encourage the employee, to strengthen his material interest, the organization is developing a provision on bonuses. In this position, the following are installed:
- types of awards;
- the procedure for approval, accrual and payment of bonuses;
- indicators and conditions of bonuses;
- sources of premium payments;
- size and scale of bonuses;
- the procedure and conditions for deprivation of bonuses or reduction of their size.
From the above, it follows that the employer himself determines which payments the bonus is charged on.

The profession of a driver implies a special specifics of work associated with certain difficulties: irregular work regime, dangers while driving, possible health problems.

Attention

The number of years worked as a driver of a vehicle is reflected in the formation of payments. Seniority affects the grade that is assigned to employees.

However, this indicator is “unstable”. It can be easily lost, as well as lost when changing jobs. And yet, does the class give any additional payments to the driver from the authorities?

Are grades payments obligatory?

The category is awarded to employees at the workplace, after certification. An employee's driving skills are assessed by a qualified commission. The assigned "professionalism" is entered into the work book.

But is the head of the organization obliged to pay the drivers material compensation for the assigned class? What is spelled out in the Labor Code of the Russian Federation in this regard?

Art. 135 of the Labor Code of the Russian Federation states that when concluding an employment contract between an employer and an employee, one of its clauses may provide for additional payments for class drivers. This can be reflected in the collective agreement. However, if such a clause is not provided, then the employer has the right not to provide his employee with additional payments. The availability and amount of surcharges for the existing category should be discussed in advance with the employer.

Labor Code of the Russian Federation

According to the Labor Code of the Russian Federation, the amount of the additional payment for the class awarded to the driver is formed by the employer himself. Specialists who have been awarded grade 1 or 2 can count on additional payments.

In most cases, the amount of financial payments is set as follows:

  • for 1 class there is an increase in the amount of 25% of the fixed rate for one flight;
  • for 2 10% is charged.

The amount of the driver's surcharge for class may be different, depending on the discretion of the authorities.

The additional payment for the 1st and 2nd category to the employees of the vehicle can be fixed in the labor contract. At the same time, when employed in an organization, an employee may not have any rank. But, he can get it in the course of his official duties.

It is worth considering that the class assigned at one workplace is not retained when moving to another, to another organization.

Additional payment for "professionalism" is subject to drivers with 1 or 2 class of class.

Order on additional payment for class to the driver

The driver's classification record is recorded in the local regulation. In order to assess the skills of the vehicle employee and, as a result, assign him a certain category for driving, a special commission headed by the head is convened at the enterprise. In addition to him, the commission includes:

  1. Chief engineer at the enterprise and his deputy. They are the presiding staff;
  2. A member of the trade union committee acts as a deputy chairperson of the commission;
  3. Head of department or engineer for the device and staff training in production;
  4. Manager of the Department of Labor Organization and Salary;
  5. Engineer in charge of occupational health and safety;
  6. Head of the shop (department), the section where the tested employee works;
  7. Chairman of the Brigadier Society or a representative of the Brigadier Council.

The composition, as well as the activities of the commission, is determined by the head on the basis of a compiled order.

The order for the driver's class surcharge is drawn up as follows:

Name of company

On the establishment of a qualification commission

"Date" "city or town"

In order to assign a qualification class to a driver

I order:

  1. Organize an acting commission to establish a class for drivers in the following composition

chairman of the commission - full name, position;

Commission secretary - full name, position;

members of the evaluation committee:

  1. Provide lists of drivers subject to qualification certification, once a year, no later than "date"
  2. Carry out the preparation of the qualification commission - to whom the full name and surname.
  3. Submit the information of the qualification commission to the head (position) no later than 20 working days from the date of the minutes of the meeting of the commission - to the chairman.

Head position, Surname / Full name

What are the co-payments?

An additional payment to the official wages for class is accrued to drivers with skill levels 1 or 2.

A certain level is assigned to a vehicle employee only if he has completed full training, upon issuance of a special certificate, which indicates one or more categories:

  1. In the presence of 1 class, an employee can drive vehicles of categories B, C, D, E;
  2. In the presence of 2 class, transport of categories B, C, E or only D is provided for management;
  3. For class 3, categories B and C correspond, or only D.

Why are they deprived of additional payments for class?

The level of professionalism assigned to the driver can be downgraded or completely canceled by the management, depending on the situation. The downgrade is recorded in the work book. However, the vehicle employee can return it to himself.

Why can they be deprived of class?

  • for exceeded fuel consumption (deviation from the certified rate);
  • for ignoring the job description;
  • for non-compliance and non-fulfillment of the established work plan, transportation schedule;
  • for frequent, fixed traffic violations, as well as involvement in road accidents;
  • for non-observance of safety measures.

Deprivation of the category is carried out for 90 days, while the employee does not lose the opportunity to pass the certification again, having made up for all the losses. For this, the procedure for obtaining the classification is the same as for the first passage.

If an employee for any reason is removed from the right to drive a working vehicle, then the class assigned to him will be canceled until the driver's license is returned to him.

Supplements for irregular working hours of the driver

Irregular working hours for car drivers are the time when the employer may demand to return to work after working hours.

If an employment contract is concluded with the driver of the vehicle, which indicates the possibility of irregular work hours, then overtime after the agreed hours will not be considered overtime, which means that the management is not obliged to compensate it with cash payments.

According to Art. 119 of the Labor Code, the employee is only entitled to compensation in the form of an extraordinary paid vacation.

Traveling nature of work

Traveling work implies different from normal working conditions. All due to the fact that the driver spends most of his working time on the road.

However, despite the fact that this type of work includes inconveniences in the form of irregular working hours, unusual climatic conditions, overtime, the Labor Code of the Russian Federation does not provide for mandatory payments to an employee, taking into account these conditions.

The Labor Code prescribes that the management of the organization must compensate the employee for all his material costs for fuel, accommodation, meals, etc. For work at night, holidays and weekends, the administration is not obliged to provide monetary compensation.

Surcharge for classroom ambulance drivers

Ambulance drivers have a special premium for "professionalism" to the official salary, which is paid monthly. The surcharges represent a specific percentage:

  • for class 1, payments are provided in the amount of 25%;
  • for grade 2 - 10%.

An additional payment for classroom ambulance drivers is provided for the hours actually worked.

Surcharge for tractor drivers

Tractor drivers, depending on their work experience, are assigned qualifications of 1, 2 or 3 classes. This classification is reflected in additional payments:

  • class 1 tractor drivers are paid extra 20% of the flat rate;
  • Tractor drivers-machinists of the 2nd class are paid extra 10%.

Additional payments to tractor drivers may vary, depending on the specifics of the organization.

Nuances

The nuance in the question of the additional payment for the classroom to drivers is that when changing the place of work, it is not saved, but canceled. But, if the management itself transferred the employee to another job, then in this case the class remains.

This means that by terminating an employment contract with one organization and transferring to another, even the title of an employee with 1st class is no longer valid. To get a discharge, you will have to go through a new recertification again.

However, some managers "go to the meeting" and keep the new employee the class he has.
