Cheated with the sale of the car what to do. Car purchase cheating - what to do? Inspection in a deserted place

When going to a car dealership for a new car, most buyers are sure that they will not be deceived there. Many motorists argue for the purchase vehicle at authorized dealer the fact that he has no risks of spending extra money, getting a low-quality car, etc. In fact, in many car dealerships, whole schemes have been worked out to deceive gullible buyers. Today we will talk about how dealers cheat when buying a new car.

Very Low Price: Worth Watching

Often in print publications, Internet resources and on street banners you can find advertisements for the sale of cars at low prices, which can differ significantly from the average market and recommended by the manufacturer.

Even if doubts about the trick crept in, the desire to get a new car at a low price prevails, and the potential buyer goes to the car dealership. Further events can develop according to one of the following scenarios:

  • The dealership manager names a price that is significantly different from the one indicated in the advertisement. All this he explains the best package specific car: the presence of all-season tires, alarms, electric booster, and so on. In such a situation, it is already difficult for a buyer to leave a car dealership with nothing.
  • After the decision on the purchase is made, the buyer is offered to make an advance and wait for the paperwork. After a while, the price in the contract brought by the manager may be higher than the originally agreed price. Sellers will find many reasons for this. But the main problem will be that the contract will prescribe a clause according to which, if the transaction is canceled, the advance payment will not be returned to the buyer.
  • There is a scheme designed for inattention and legal illiteracy of the buyer. The buyer reads the first page of the agreement, where the main parameters of the transaction are indicated, including the price of the car. He skims the rest of the pages and puts his signature on each sheet of the contract. After the question of when the long-awaited car will be given to him, it turns out that it is necessary to pay additional money for the imposed accessories or unnecessary services.
  • After choosing a car at an attractive price and making an advance payment, you may find that its equipment is different from the one that the buyer wanted to buy.
  • The price stated in the advertisement and indicated in the contract may be exclusive of VAT.

These methods of cheating the buyer are one of the most common. In fact, there are many more of them. The low price is, in fact, the first reason to be on your guard and check. They don't buy a car every day. Before going to a car dealership with the required amount of money, it is worth examining all the offers of car dealers in the region. Also, before the final choice of the seller, you must try to find out as much information as possible about him, look for real reviews.

The following rules will help to avoid cheating when buying a new car:

  • You cannot deposit any funds before signing the contract. When paying, be sure to get a receipt.
  • You cannot tell the manager of the car dealership the amount of money that is intended for the purchase of a car. If it is higher than the cost of the car in the salon, the client will be sure to "hang" optional equipment.
  • The sales contract must be carefully reviewed. All copies of the agreement should be read, even if it takes a long time. If the buyer is unsure of his own legal knowledge, it is better to bring a lawyer with him.
  • The contract must state that the price of the car is final. Otherwise, a situation may arise when the dealer requires a surcharge for the additional complete set, which was not discussed.
  • The buyer should be alerted to any delay associated with registration, attempts to divert attention, artificial creation of red tape.

Used car at the price of a new one

Selling a used car disguised as a new one is a common fraudulent scheme at car dealerships. It is very difficult to determine the condition of the car by its appearance, whether it is new or used. Even if the buyer has doubts creeping in, the car dealership manager will give prepared answers to an inconvenient question. For example, they may say that the car was operated in test drives (this may explain the lower price).

When buying a new car, you should be alert:

  • the presence of a "duplicate" mark on the vehicle passport;
  • proposal for a longer warranty service, compared to other dealers;
  • offer to do maintenance for free or with a big discount.

At the slightest suspicion that the car was in operation, a serious reason to go to another car dealership.

Not all car enthusiasts can purchase a car at their own expense. Dealer cooperation with a specific bank is a common situation. If, during the first visit to the salon, the buyer mentions that he plans to take out a loan, they will begin to convince him that the conditions of the partner bank are the most favorable. As practice shows, this does not always correspond to reality. For attracting a client, a car dealership can receive a commission from a credit institution, which the bank, in turn, veiledly transfers onto the shoulders of the client.

Exactly the same scheme of work can exist with an insurance company. The bank requires to insure the pledged car, but this can be done only in a certain insurance company, which cannot boast of low rates. The car dealer will receive commission income for attracting a customer from the insurer.

Based on this, it is worthwhile to independently monitor bank offers for car loans and find the most acceptable result, in terms of interest rate, loan term, additional fees, etc.

In addition, dealership managers often persuade the buyer to buy a more expensive model than he expected. They are actively offering to take out a loan for the missing amount. As a result, the client spends a lot more, as he has to pay a commission, insurance payment, etc.

Unprofitable trade-in

A common way to cheat a buyer is a trade-in scheme, which consists in exchanging an old car for a new one with a surcharge. The essence of the fraud lies in the fact that a salon service station specialist convinces the car owner about the presence of numerous malfunctions and external damages in the old car. This is done in order to buy back the vehicle at the lowest price. The new car will be offered at a cost higher than in other car dealerships. Therefore, if there is no particular urgency, it is better to sell the car yourself.

Own exchange rate

Despite the fact that, according to Russian law, all settlements on the territory of the country must be made in rubles, some car dealers continue to operate with prices indicated in US dollars. The buyer may find out that the rate used in the showroom is higher than the rate of the central bank. Moreover, the question may emerge after the deposit is made, when the refusal to purchase will lead to a loss of funds. If the contract price vehicle is specified in foreign currency, then the buyer must demand to indicate in it and the equivalent in rubles.

Additional equipment

It is profitable for the salon to sell a car with the maximum configuration and with a large number of additional accessories... The manager will professionally convince about the importance of additional options. As a result, even an experienced driver will believe that they are really needed. Therefore, before heading to a car dealership, it is worth considering which elements are really needed and which will only be a waste of money. In addition, all additional equipment and accessories can be purchased elsewhere at lower prices.

Fictional hype

After choosing a car and its configuration, it turns out that such a single copy remains in the cabin, and it has already been booked by another buyer. The waiting time, according to the salon manager, can take several months. Further, the representative of the car dealer will tell you that there is a long line in the salon for such a car, but for a certain fee he is ready to negotiate with the first client, and he will refuse the deal. An additional argument will be the reasoning about a possible price increase. In fact, this is the most real extortion.

Test drive will reduce risks

After the choice is made, the car must be carefully inspected. It can have hidden defects and damage, even if the dealer does not cheat and the vehicle is really new. The car could be damaged when unloading from a car transporter or unsuccessful parking carried out by an employee of the salon. Defects are most common paintwork that are skillfully disguised. If you find such shortcomings, you can safely ask for a discount on the car.

During a test drive, you must carefully listen to how the motor works: there should not be any extraneous noise and knocks. It is worth checking the operation of all external lighting devices.

After a test drive, it is better not to turn off the engine at once, but to open the hood to listen to the operation of all its units. If the driver does not have sufficient experience, it is advisable to invite a specialist with him.

Finally, it is necessary to verify the body number indicated in the vehicle passport with the number on the car.

When signing the acceptance certificate, you need to verify the presence of everything that is indicated in it. Otherwise, it will be impossible to make a claim to the car dealership.

I am glad to welcome you, dear visitors, to the pages of my blog!

This next publication of mine will tell you about such a sad phenomenon as fraud when buying a car, which happens not so rarely, and not only with "suckers".

Did you know that these car scams and scams are the most common of all car crimes? Are you aware that when a car is sold by a private owner on the Internet, outbid in a car market, or even in a car dealership, sellers almost always deceive the buyer?

Various types of all sorts of tricks associated with the sale of cars have long become almost an obligatory attribute of the "correct" sale of cars, and cunning machinations and criminal schemes have become a gray routine. People got scared to spend their money on auto-secondary.

How can you avoid such troubles associated with buying a car and conclude a normal deal? Is this possible for an ordinary person? In my experience, I can tell you that it is. Not only outbids are able to successfully spin on this topic, so can you. Not as professional, but clearly distinguishing between the main types and tricks of scams associated with cars, you can definitely do it.

The first thing we should talk about with you is finding the right purchase option with favorable conditions for you.

Now in the secondary car market, this is mainly done by searching through the Internet on online car sites, where a lot of advertisements for the sale and exchange of cars and their components are posted.

This method is very convenient - you can quickly work out a large number of options. Personally, I like it. But not all ads are posted by honest people and not all of them are targeted. Let's take a look at their main types.

There are five of them:

  • Private traders;
  • Outbid;
  • Swindlers;
  • Scammers;
  • Pacifiers.

"Honest" private traders

I took the first word in quotation marks for a reason. Absolutely honest private traders have not been found for a long time, so it is better not to hope for this at all and constantly have healthy suspicion.

Distinctive features of private ads:

  • The car belongs to him personally;
  • Willingness to provide all documents;
  • Many photographs in different areas with visible numbers;
  • Their description is large and detailed;
  • The price is set real;
  • They often make typos and mistakes in the description;
  • The place of inspection is specific or not essential;
  • Adequate and accurate landline telephone and address contacts.

This is the best option to buy where you can find a good car. The owner may be hiding something, but usually these cars are legally clean and the deal has few complications.

The main goal of the seller is to sell what is more profitable, cheating on little things.

Outbid and salons

These are sour berries from the same field and there is little that distinguishes them from each other:

  • Outwardly, the announcements look standard and short, with outbids they are often sloppy;
  • The price is often understated and does not correspond to the specified mileage and year;
  • All high quality photos taken in one place;
  • Contacts are always slippery, with the possibility of quick replacement: mob. phone, mail, social network;
  • The site is usually just the name of the city;
  • The mileage must be specified with an accuracy of a kilometer;
  • Salons always appear in the personalities of girls;
  • Almost always they indicate: “do not bother salons and outbid”, “bargaining at the hood”, “one owner”.

The machines are real, but their data may differ from those declared as heaven and earth, keep this in mind.

The main goal of the seller is to break off more from someone else's, cheating as you like.

Swindlers

The main signs here are the same as in the case of outbids / salons, but there are also some peculiarities:

  • Highly nice car with a very favorable price;
  • Weight detailed photos and technical characteristics, drawn up well, right with the professional skills of marketing marketing.
  • There are always real and cool cars, "decent" owners, with the obligatory problems of providing complete documentation and believable stories in this regard.

The car here is often not just real, but also pretty good. It is these banks that take as collateral.

The main goal of the seller is to foist a sucker with a car with a bunch of tough legal problems.

Scammers

Do not let you meet with this brethren, but some of them themselves do not suppose.

Their main differences:

  • Maximum paucity of specifics;
  • Photos are always with closed numbers;
  • The sale is always nowhere more urgent;
  • The price of a car is simply unrealistically low, like in a fabulous mousetrap with cheese;
  • The ads themselves live no more than a couple of days.

Their calculation is made on the greed of the buyer and the real car does not always appear in the scheme.

The main goal of the "seller" is to cheat you for money.

Pacifiers

Well, these are the same outbids and car dealerships, artificially lowering the price with a mass of fake (fake) ads. This is done in order to mislead private traders, to buy back their cars at a cost below market value;

The main differences are:

  • Options are offered, according to which the car leaves in a couple of hours, and these announcements hang for a couple of years;
  • Contacts are always phony.

There are no cars here and there never will be.

The main goal of the "seller" is for you to take the "price" of their ads into account when you go to the auto site to find out the average prices.

For a question related to ads on car sites, you can also watch two parts of the videos below.

By the way, I think you might also need a special extension: AutoBurn. It is installed in leading browsers (Chrome, Firefox) and automatically determines the number of sales for a selected user in ad sections on popular auto portals. With the help of this tool, resellers are easily weeded out, which gives significant assistance to the motorist in his search for the desired option.

Legal check of the car

This is the second and most important stage in purchasing a car. Because if you are scouted in a technical vehicle, then it is at least physically fixable, but with a tough legal scam, you can have completely insoluble or intractable problems and regret buying more than once.

Let's say you have already chosen your option and call the seller with the intention to schedule an initial inspection. So, be sure to warn him that you need a full package of documents. Or the inspection is canceled.

Here you can start to "vpar" all sorts of plausible stories. Don't get fooled. This is a sure sign of being outbid, or worse. Look for another option. If the required documents are easily agreed to provide, then this is a good sign.

Here's what you need to request for a meeting:

  • Identity document (ideally driving license and passport);
  • Vehicle passport (PTS);
  • Vehicle Registration Certificate (STS).

And keep in mind, if you come across childish tricks like: "Oh, but I forgot this and that ...", then do not even think to follow the lead: "but let's get by with what we have, and then ..." - this is a clear deception.

Preliminary stage of document verification

Check the TCP immediately:

  • The number of owners and the terms of their ownership of the vehicle;
  • Make sure that this TCP not a duplicate: it is sure to indicate this in prominent places, but you check all the corners;
  • If PTS is duplicated, then pay attention to the reason (loss, unusability) and the car itself: the old and the killed car is out of suspicion, and if the new one, then it is better to leave (especially if the price is sharply reduced) so as not to get on the "credit card". you can buy only if the owner does not hide it;
  • Check the completion of the bottom field of the last owner's form in the TCP: it must be filled in with data from the traffic police (numbers, state registration plate, dates). If this field is empty or without seals and signatures, then the car was not registered and its STS is registered with the previous owner. In this case, refuse;
  • Personal data in the TCP and STS must match the data in the license and passport. Leave tales about relatives and godfathers on which the car is issued. You may even be shown insurance with the name of the seller, but outbids are arranged with the owners ahead of time.

The main stage of document verification

Previously, this was not necessary. In the traffic police, during the pre-sale deregistration, the car was punched through the base. But since 2013, the mandatory withdrawal has been canceled and people, until recently, toiled with a check with the traffic cops they knew. There were a lot of credit card machines and other kiddies.

Recently, this problem was finally solved by opening the necessary sections of the traffic police database for free access. A number of other services have also appeared to check various aspects. legal purity vehicles and their owners.

Of course, this is somewhat troublesome, but do not be lazy and exercise caution, especially in cases when they offer an attractive price and rush, motivated by an urgent need for money.

This is often the case for fraudsters, psychologically inflating their victims by inciting greed in them at a low cost and imitating urgency. Then a person can rely "at random" and buy an option that is profitable from his point of view, hoping for a good one.

Therefore, having collected all the necessary data on the purchased car and on the seller (passport data and data from the STS or PTS), take a few hours to "punch" both of them on the Internet services. This will not give one hundred percent protection, but it will reduce the risk many times over.

If you are pressed for time, then check the car on at least two resources:

  1. The car on the website "State traffic inspectorate" - this is done by the identification number (VIN) entered in the appropriate field or by the chassis number and body numbers. Ideally, there is no mention of the car in the database;
  2. The owner is on the website "Federal Bailiff Service" - here you can find out that, for example, a certain bank has applied for the sought-after person to collect collateral from him. So your seller is a beetle.

However, it is better to apply a broader due diligence.

In order to bypass all the services I offer, scammers must be extra-professionals, and there are few such crooks and they "work" only in the premium class, without being sprayed even on the middle price segment. Therefore, if you buy a budget and middle class option, then a comprehensive check on this list services will give a result of reliability close to 100%, taking into account relativity, of course.

So, these are the services:

  1. Main Directorate for Migration Issues of the Ministry of Internal Affairs of Russia - checking the seller's passport;
  2. Electronic justice - search in databases of court proceedings;
  3. Federal Tax Service - search for tax violations;
  4. Federal Bailiff Service - search through the databases of seized property;
  5. Federal Chamber of Notaries - search in the registers of notices on the pledge of movable property;
  6. State traffic inspectorate - search in the databases of the wanted transport;
  7. Autocode website - history of car ownership and operation (for Moscow);
  8. Auto.Ru website - VIN-code check;
  9. Website "Adaperio" - checking the car by state number and VIN code.

Car technical check

At this stage, it is difficult to 100% protect yourself from deception. On a technical basis, everyone is deceiving and without any twinge of conscience. Your task is to identify as many hidden defects as possible and, on the basis of this, bring down the price as much as possible, if the revealed did not convince you to abandon the purchase.

The technical inspection is carried out approximately according to the following scheme, as much as possible excluding the possibility of major deception of the true state of the car:

A couple of hidden defects revealed may be of little significance, but if they "pop up" in sets, then it is better to refuse the purchase.

In the video below, when inspecting the car, a huge number of problems were revealed.

Popular fraud schemes

Now I will describe the main schemes and methods of fraud that the buyer should know about.

Duplicate PTS

When a person takes out a loan secured by a vehicle, the bank takes the registration certificate from him and the car is legally considered a temporary pledge property of the bank. In the traffic police, we can say that the passport is lost and they will restore it, without punching the banks for the car's credibility. So the unwary people are "sold" smart credit "cars". It is almost impossible to prove anything to the bank later.

"Documents" outbid

The reseller will never enter himself in the registration certificate and will not put the car on record - this is extra money and hassle. That is why you need to look at the seller's personal documents in order to calculate the outbid.

Why is outbid a bad option, you ask? After all, they can sell good cars. Yes they can. But they do not like to be bound by obligations through the documentation and, in case of deception, then you will simply have no one to demand justice from.

When the outbid takes a car for sale, he does not draw up a purchase and sale agreement (DCT) with the owner, but takes a receipt that the car has been bought, the money has been paid and there are no complaints. Then the outbid will take you to the familiar "solicitors" and they will draw up and certify the DKP on the basis of a copy of the owner's passport and your documents. The outbid will sign it instead of the owner with a similar fake signature. The bottom line is that in such an agreement, the outbid does not appear at all, and the owner did not sign it. You will never win any court with this paper.

Car without registration. Includes deception of the seller. Now there is no need for transits and deregistration, therefore new owner may not register a car within the prescribed 10-day period due to forgetfulness or unwillingness. Then the owner has the right to write an application to the MREO for the removal of the vehicle from the register. As a result, the car gets into the traffic police database as wanted. They catch him and put him in the impound. The new owner will be fined, and the subsequent registration will be very problematic.

Alternatively, if neither the owner nor the buyer is active in registration, then all fines and taxes will go to the old owner. Fraudsters sometimes use this on special occasions.

Well, there are precedents for outright hooliganism on the part of the seller. If, having received your fine, he gets angry, he can write an application for the disposal of "his" car. Then the car will get stuck in a joke and turn into the subject of troublesome and unpromising litigation.

Similar problems can be caused by the sale of a car by proxy.

Buyer divorce in a car dealership

Used for both new and used car. You liked the car in the car dealership for a very favorable price and you decide to buy it. On the spot you will be convinced that the price is true and you will sign a 25-page contract without reading it in full.

But as soon as you pay the required amount, another document will be put in front of you, according to which you will be required to pay almost the same amount for the services of the salon, well, or something like that. The pill will certainly be sweetened by the possibility of you paying this robbery in installments.

Of course, you will be indignant and refuse the deal and you will be offered to cancel it. You will do it with joy, and the salon manager will sadly put in front of you a third piece of paper, according to which a penalty in the amount of half of the deposited amount will be withheld from you. And all this is absolutely legal!

Such schemes are often found in Moscow, for example, where buyers from the regions, who are the easiest to cheat, are frequent victims of divorce.

The two videos below focus on cheating buyers at car dealerships - the most insidious type of car scam.

Divorce prepaid

Having found a very attractive option, you will call the seller, from whom you will find out that he does not live in this city, but actually sells the specified car at the specified price. Only very urgent, therefore cheap.

You will say that you are leaving for inspection. The owner will answer that you can go and in vain - those who want to call constantly, they can get ahead. Then you yourself offer to send an advance payment, to which the “seller” easily agrees. You part with a certain, sometimes significant, amount, and this is where the "deal" ends.

It is about such a divorce that is described in this video.

Complex theatrical schemes

It happens that scammers use very intricate schemes. For example, they show a car and act out a whole performance with two characters: the "salesman" and his friend (accomplice). There are many options for this idea, but the main point is that the “seller” goes “for five minutes” to “his apartment” with the buyer's money, leaving the accomplice with him “as a pledge”.

When the “seller” is delayed, the accomplice goes to “rush” him, leaving the buyer to stand by someone else's parked car, which the crooks passed off as their own. This draws the curtain down.

Robbery

In fact, outright robbery is not accepted among the elite environment of scammers and swindlers. By doing this, they are dropping their high criminally qualified authority. But robbery with elements of fraud, or vice versa, can take place. For example, a crook caught you with a dummy car and set the time of the deal.

They know that you left with the money, they know the route and time. On the way, a small accident happens and you will be deliberately carried away by the proceedings, and the money from the cabin will evaporate just at this time.

  • If you think that you are being deceived, then you better believe yourself. It doesn't seem to you! In auto buying, it is more profitable to trust your intuition, which does not oblige you to anything.
  • Check the condition of the engine number very carefully. All suspicious deviations from the norm will indicate that the car is "broken" and, most likely, criminal (in theft).
  • If during a test drive the owner tries to distract you with a conversation or turns on the radio loudly, then there is a possibility of knocking in the engine or suspension.
  • If the owner stubbornly does not let you drive, then automatic transmission transmissions are most likely not completely serviceable.

And one more good advice about the appropriateness of using for checking car services, you will find in this video.

Conclusion

Well, let's summarize some of the results of our conversation with you today:

  • When buying a car with secondary market fraudulent risks are many times higher than similar ones, for example, in the sale of secondary housing;
  • Going to buy a car, you should know the basic schemes of divorce and fraud, even if you buy it in a respectable car dealership;
  • The best protection for the car buyer will be a good detailed course of special training against experienced outbidding.

Concluding our conversation with you, I want to remind you that there is no need to be afraid of the secondary market. This is a very useful niche that requires only knowledge about its specifics, attentiveness and caution.

Many future drivers enter into a contract in order to safely receive a vehicle without any problems. However, fraudsters in the market can often be found among both buyers and sellers. There are different situations when citizens deliberately want to protect themselves from fraudsters and have no idea how to do it. There are standard scam schemes that you should be aware of.

How can you cheat when buying a car?

If you have entered into a relevant agreement that was drawn up on the basis of Civil Code and did not receive the vehicle, you have the right to terminate it, and then return the funds through the court. However, the circumstances are different. For example, the buyer, upon inspection, understands that the car is in perfect condition.

The parties agree on the purchase, and the seller says that he is ready to sign the contract, but only tomorrow. He would like to receive an advance. The buyer gives the money, and the seller disappears completely. The way out of the situation is this: in order not to get into this situation, draw up a receipt for a deposit. Never give a final cost.

What you need to know when buying a new car in the salon so as not to be deceived?

If you want to fully protect yourself when purchasing a vehicle, do not assume that everything is as safe as possible in the car salon. Most people think that if they buy a car from an authorized dealer, then all the problems of cheating are reduced to nothing.

In fact, car dealerships often deceive their customers during the period of purchasing a vehicle. Any client can be. Fraudsters have never been differentiated by gender and lawyer skills. It doesn't matter if you are a professional with many years of experience or a beginner. It doesn't matter if you are a woman or a man. You have a chance not only not to get your vehicle, but also completely lose money.

How not to be deceived when buying a used car?

Buying a used car is considered a daunting task. You may be deceived by a scammer. Especially if you are buying a vehicle for the first time on automotive market... There are various points to pay attention to during the purchase period. One important factor is to pay special attention to the physical part before you make a decision. After all, positive emotions and the feeling that you are a few steps away from the desired result are often deceiving.

Where to go for help if you were deceived when buying a car?

There is, according to which the abuse of consumer confidence is regulated. In other words, it is about fraud. In this case, you must apply to the car dealership. If he is not accepted, threaten the prosecutor's office. The court will later figure out why you were deceived and, most likely, will revoke the license from the organization. The main thing is to find a professional lawyer who will understand this matter. The cost of their services is different. It all depends on the current reputation and quality services that are provided to them.

It is worth noting that before buying a car, you need to study reviews on the Internet. Keep in mind that many of the reviews that were overwhelmingly positive were commissioned. As a rule, people very rarely leave positive reviews. They instantly try to throw out the negative. Therefore, pay the most attention to negative reviews. They are much closer to the truth. Also ask for advice from friends and acquaintances who have been to this car dealership or bought a great car.

Car buying and selling scams are commonplace, and it is as easy as shelling pears to fall into the trap. This is due to the fact that the used vehicle market provides maneuvers for scammers seeking to enrich themselves at the expense of ordinary buyers and sellers. So what are the most common car buying and selling scams used by scammers and what is their point? What should you first of all pay attention to when making a deal and how not to become a victim of scammers? What should be done if the car owner has become a victim of scammers? We will try to answer these questions in this article.

Common schemes of fraud when buying a car

It is clear that the comparative risks of vehicle sellers and buyers are not the same. So, the latter are deceived much more often, but at the same time the damage caused to sellers is many times greater, since most often the object of illegal actions is either a large amount or the car itself. So, first, let's look at the types of fraud aimed at deceiving buyers. Each of the following methods is equally common:

  • Sale of a car purchased on credit. The seller will not mention that the car was bought with credit funds, and the credit relationship is still valid. On the contrary, they will be lured by all available means - relatively low cost, low mileage, etc. Then, when making a deal, they will provide a duplicate of the TCP, claiming that the original was lost. At the same time, getting a duplicate in the traffic police is as easy as shelling pears, all you need to do is write an application and pay a fee. After the transaction is completed and the money is transferred, the borrower will stop paying monthly payments on the car loan, and the bank declares the car on the wanted list and that's it, the new owner is left without money and without a vehicle;
  • Car sale with advance payment. It often happens that the seller and the buyer agree on the transaction and the seller asks for a deposit as a guarantor of a future purchase. But unscrupulous sellers, having taken possession of the advance payment, disappear from sight. At the same time, it is practiced to leave a deposit without issuing a document confirming its introduction. Then the buyer is left with nothing, and the seller continues to practice such a sale. Some scammers manage to get an advance payment for cars that do not exist at all. According to the scammers, the car is located outside the Russian Federation and funds are required for its transportation, customs clearance, etc. To lull the vigilance, the buyer is presented with a contract with all the attributes (signatures, seals) of the company that provides the relevant services and after receiving the prepayment, the seller dissolves;
  • Selling an illiquid car disguised as a car in excellent condition. This is a classic among scam scams. In fact, the "killed" car undergoes serious pre-sale preparation, appearance brought by craftsmen into a state close to ideal and an excessively high price is set accordingly, and in fact the car is rotten from the inside or was seriously damaged, or completely restored after an accident;
  • Sale of cars by dealers and car dealerships on credit. Here the fantasy of sellers and lenders went far. Car dealerships and dealers practice attracting customers with promotions and discounts, which, after the transaction is completed, are often accompanied by unnecessary spending. Promotional cars are usually sold in basic configuration, and employees persistently impose additional options etc. Loan agreements contain additional commissions in excess of the interest charged on the amount of the debt.

These schemes are the most common in automotive industry and despite what is known about them big circle car enthusiasts, they still work. In most cases, this is the merit of the scammers themselves, who masterfully enter the trust and win over a potential buyer who cannot even imagine that he will be deceived. Therefore, when making purchase and sale transactions, when it is not possible to objectively verify the decency of the seller, it is worth paying attention to:

  • Authenticity of documents for cars. A duplicate requires a small check, first of all, for the presence of encumbrances (pledge to the bank). The traffic police website makes it possible for free to find out about encumbrances and other information, and in the case of purchasing a vehicle bought on credit, you need to ask for a certificate from the bank that the debt has been repaid;
  • Requests for an advance payment for the car. You should not transfer money as payment or prepayment without receiving supporting documents (check, receipt). The receipt must contain both the amount transferred and the currency, as well as information about the recipient of the money;
  • Doubts about the condition of the car, which involve contacting the service station. A trip to the station is recommended for all buyers who do not have sufficient knowledge of the car's structure;
  • Contract provisions. When buying in a showroom for shares or on credit, you need to read the agreement, where the conditions for selling a car for a promotion or on credit may be hidden, which significantly increase the purchase price. An invited lawyer can evaluate the contract.

Selling or buying a vehicle is always a risk, since we are talking about a valuable property and a fairly large amount of money. Any person, even one who is legally savvy in this area, can fall for the scammers' trick. Therefore, before making a deal, it is always better to play it safe, to pay more attention to the study of all the nuances, than then to defend your rights in the courts.

What types of fraud are encountered when selling a car?

Sellers are less likely than buyers to suffer from scammers, but this happens. At the same time, the fraud schemes are much more sophisticated, since the seller initially does not have the most advantageous position- he is more open to information, his data is in the announcement of the sale of a car, or he presents them to a potential buyer, without thinking about the consequences. According to statistics, it is car dealers who most often become victims of physical violence when trying to get money for their car. So, most often fraudulent schemes are as follows:

  • Emptying the merchant's bank account. The pseudo-buyer agrees to the purchase without bargaining, asks to book a car and not put it up for further sale, and at the same time is ready to deposit an advance to the seller's account right now. The elated seller is happy to give the card details (number, due date, and a three-digit number on the back - CVV code) and expects the first part of the payment to arrive. But here nothing happens and the agitated seller asks the buyer what the difficulties are, to which he replies that the bank demanded additional confirmation of the account to complete the operation. Confirmation is carried out via mobile communication, an SMS with a code is sent to the seller's number, which must be reported to the buyer in the bank, and after the attacker takes possession of the code, all funds disappear from the account.
  • Falsification of information in Internet banking. This is a scam, usually of the luxury class, concerns expensive cars and wealthy salespeople. Using Computer techologies, in banking, false information is entered about the receipt of money as payment, although in fact this is not.
  • Bearer check. When buying, the attacker makes a settlement by writing a check with the required amount, but the account from which such an amount should be debited is either not, or by the time the seller appears in the bank, it is empty.
  • Case with a secret. This is where scammers need sleight of hand. In a special case there are two compartments, one is the main one, presented to the seller with real money for viewing, the other is hidden, where the fakes are located. After the seller recounts the money, the parties are sent to complete the transaction, but between the recounting and the transfer of the case, the cash disappears, and only fakes remain.
  • Sale through a car dealership or auto house. The seller hands over his used car, they put it up at their own price, but not lower than the one declared by the seller and it can stand indefinitely until the seller runs out of patience and he does not want to return the car back, because there were no buyers. But the contract, as a rule, provides for the clause that the return of the car involves the payment of a commission, the amount of which will be equal to 1/4 of the cost of the car, which was established by the intermediary.

The sophisticated mind of scammers gives rise to ideas of enrichment with incredible speed... In addition to the above methods, the seller can be fooled right during the test drive. For example, steal the second key from the car, so that later you can simply steal the vehicle you like. Therefore, you should not come alone to meetings with potential buyers, it can be fraught. In addition, for the safety of the transaction, sellers should:

  • Carry out all actions when selling a car with a client during daylight hours (show a car, draw up a contract, etc.) in relatively crowded places;
  • Do not remove the car from the register ahead of schedule at the request of the buyer;
  • Agree on the route of checking the car on the road in advance and take someone with you on it;
  • Check the money for authenticity when received as payment, so that the money is no longer out of sight or even with the seller. When signing the contract, the funds should be checked again, including recalculated;
  • Do not hesitate and put the proceeds in the bank, and do not carry it around the city.

If the seller got into one of the above situations, then he should contact the law enforcement agencies with a corresponding statement and provide all documents and other evidence of the transaction (for example, counterfeit money). Most likely, a criminal case will be initiated under article 159 of the Criminal Code of the Russian Federation, and if the fraudsters are caught, they will face a large fine, imprisonment or other type of punishment provided for such a crime.

Conclusion

When making transactions for the sale of a car, you should be vigilant and make sure of the honesty of the other party before signing any documents, giving or transferring money, etc. If there is such an opportunity, it is better to involve a competent person in the procedure, for example, a lawyer. If this is not possible, then it is better to refuse a dubious deal than to risk it, since you can be left with nothing.
