Rules for transporting children on the bus.

What changes have appeared?

The last revision of the document introduced the following changes: Introduced a new concept of “organized transportation of children”.

Previously, this term was accepted: any transportation of 8 or more children; transportation is not carried out by route vehicles... Currently, it has been clarified that transportation is carried out without representatives of children, which include parents, adoptive parents, guardians or trustees. The exceptions are situations when the official representative is: the accompanying group or a medical worker, whose presence is required during the transportation.

Based on this change, it turns out that if the transportation of children is carried out accompanied by parents who are not accompanying the group, for example, a group of tourists consisting of children and parents, then it is carried out on the basis of general rules not related to carriage organized groups children established by decree No. 1177. In this situation, parents or legal representatives must independently ensure the safety of the child on the basis of the carriage agreement and the rules for transporting children in the traffic rules bus 2016.

The new regulatory document included the mandatory fulfillment of the following conditions:

  • children must be more than 8;
  • the bus should not stand on the route and appear at the given moment by public transport;
  • escort of buses with children is currently provided only if there is a convoy consisting of 3 or more vehicles;
  • for the transportation of children, a permit is required, the document is issued by an authorized employee of the district traffic police. Until 2016, the original of the permit had to be with the driver and presented at the first request of the traffic police officer. After making changes, the driver only needs to have a copy of this document. The originals must be kept by the company for at least 3 years after the transportation;
  • the carriage of children from 11 pm to 6 pm is allowed only in exceptional cases, which include: moving to railway or air stations to reduce the waiting time for the departure of a train (plane); unplanned delays while driving, for example, due to bad road or weather conditions. Movement after 23 o'clock should be carried out at a distance of no more than 50 km. If not, the group leader must decide on an unscheduled stop in order to give the children time to rest.

So, with the organized transportation of small passengers, special attention must be paid to: the need to be accompanied by a car inspection crew; completeness of documentation; requirements for the driver and buses; requirements for persons accompanying children; the rules of boarding a vehicle.

Escorting a group of children from the traffic police

Initially, you need to decide on the transport company or other person who will carry out the transportation. Further, a charter contract is concluded between the person responsible for the group of children and the performer himself. On the basis of this agreement and the message of data on the route, an appropriate notification is made about the transportation of children by bus to the traffic police. To receive an escort of a convoy of buses, consisting of 3 or more buses, by the traffic police, it is required to submit a written application for escort no later than two days before the start of transportation.

An application for escorting the State Traffic Inspectorate with a car must contain the following data:

  • the time period in which support is required;
  • the route of the column;
  • the number of buses involved, their make and model with license plates, as well as data driving license their drivers;
  • customer name;
  • name transport company or carrier;
  • Full name of the accompanying group;
  • amount of children.

The application is submitted by a representative of the carrier organization to the regional department of the State Traffic Inspectorate. The response from the traffic police is also drawn up and transmitted to the applicant in writing.

If children are transported by one or two buses, then at the traffic police department (also a maximum of 2 days before the trip) a notification about the carriage of children is given.

The document must contain:

  • information about the company that organizes the transportation;
  • information about the carrier company;
  • date of transportation;
  • the route of the bus, supplemented by the names of the starting and ending points;
  • the number of children transported, indicating the age category;
  • the make and license plate number of the bus delivering children;
  • data of the person accompanying the group.

The notice must be marked that the State Traffic Inspectorate knows and allows the transportation of children along the specified route and at the specified time. A copy of the application for escort or notice of transportation is a mandatory document that must be kept by the driver. As a result, the person responsible for the transportation of children must receive one of the following documents: a copy of the notification of the transportation of children by bus, or a copy of the approved convoy escort by traffic police vehicles.

During the movement of the convoy, there should be no one in the cabins, except for those persons who are included in the lists drawn up. If it is planned that someone will be planted while driving, then he must be included in the list in advance.

Required documentation for transporting children

To transport children, you need to prepare a large package of accompanying documents, which should include the following:

  • a charter or carriage agreement concluded between the organizer and the performer of carriage;
  • a document containing information about a medical worker who is obliged to accompany a group of children when a convoy or a bus moves for more than 12 hours;
  • copy of the transportation permit;
  • copies of the notice of carriage or application for escort;
  • list of persons accompanying the group. The list requires specifying not only the full names of people, but also passport details and contact numbers for emergency communication; list of children (name and age);
  • a list of food products that children may have during transportation. Most often, the list includes dry rations and bottled water;
  • a document reflecting information about bus drivers involved in the transportation of children. The document must reflect: the full name of the drivers, the details of the driver's license, contact numbers;
  • a document reflecting the procedure for boarding children on the bus, indicating a separate seat for each person. The document can be drawn up: by the organizer of the trip; accompanying person; a medical professional, taking into account the individual characteristics of each child; a representative of the carrier company, if this condition is an integral part of the concluded contract of carriage;
  • a document containing the route of the trip, which includes: the schedule of the bus with the definition of the time interval of movement, the place of stops for rest, meals, excursions, indicating the name of the organization that provides the appropriate action. For example, the name of the hotel in which children should stay for recreation or the names of organizations that conducted excursions, dates and estimated times of stops for the needs of passengers;
  • When a convoy of buses moves, each vehicle is assigned a serial number, which it must adhere to when driving.
  • All documents must be handed over to the driver one day before the transportation of children.

It is worth noting that until 2016 the driver had to have continuous experience for 12 months. If there was at least one day, then it was automatically not allowed to control.

Buses must meet the following requirements:

As for the admission of vehicles to organized transportation of children, the new requirements should come into force on January 1, 2017.

These include:

  • Availability diagnostic card or coupon technical inspection confirming the good condition of the bus;
  • the age of the bus must not exceed 10 years from the date of issue of the vehicle;
  • all buses must be equipped with tachographs - special devices tracking the speed of the vehicle, observing the work and rest regime of drivers;
  • all buses must be equipped satellite systems navigation Glonass, which allows you to determine the location of the vehicle at any time.

REQUIREMENTS FOR ACCOMPANYING ADULTS

When transporting children, accompanying persons must be appointed, the main duties of which are:

  • coordination of the bus movement in case of unforeseen circumstances, for example, when weather conditions worsen;
  • tracking the behavior, health and nutrition of children during transportation.

The number of accompanying persons in one bus is determined by the number of doors that each vehicle has. That is, an adult responsible for children during transportation must be at each door to avoid accidents while driving. If there are several accompanying persons on the bus, then a responsible person is appointed among them, coordinating the work of all adults.

ADMISSION TO THE BUS

The group for transportation can include children of different age categories. The only restriction applies to children under the age of 7. Such persons can be transported in groups only if the travel time is less than 4 hours. In other cases, transportation of small children in groups is prohibited. Children on the list provided by the group leader are allowed on the bus for transportation. Other persons are not allowed on the buses. However, at its discretion, the list of children can be changed unilaterally before the vehicle starts moving, that is, the group leader or other person in charge of drawing up the document can change the list without prior notice to the carrier.

Liability for incorrect transportation

Every organized transportation of children must be carried out in accordance with accepted and established rules. For each unfulfilled requirement, a fine is provided in accordance with Art. 12.23 Administrative Code.

There is a fine based on the Code of Crimes for transporting children incorrectly in any of the following cases:

  • the transportation of children does not meet the requirements;
  • the driver does not meet the requirements;
  • there is no charter agreement;
  • route inconsistent;
  • there is no list of children and those responsible;
  • for drivers 3 thousand rubles, for due. persons 25 thousand rubles, for legal entities persons - 100 thousand rubles.

There is also a fine for transporting children at night:

for drivers 5 thousand rubles or deprivation of VU for 4-6 months, for due. persons 50 thousand rubles, for legal entities - 200 thousand rubles.

Transportation of children must be carried out in strict observance of the rules approved by the Government Decree No. 1177. To ensure the maximum safety of young passengers, the rules are constantly changing and supplemented, based on other regulations and the environment.

The rules for the carriage of children on the bus have been developed with the aim of ensuring the maximum safety of minors during organized trips. Special regulations governing the transportation of children on the bus are approved by law. There are specific requirements for the driver, vehicle and escort.

When and who approved the rules

The Ministry of Transport of the Russian Federation has developed rules for the organized transportation of groups of children. By Government Decree No. 1177 of December 17, 2013, the document was approved.

Under the term " bus transportation children "means:

  • Any transportation of minors, in the amount of 8 people or more.
  • Transportation by non-route vehicles.
  • Transportation of groups of children without their representatives (parents, adoptive parents, guardians).

An exception can be made if the representative is:

  • A medical worker, and his presence is mandatory for transportation.
  • Accompanying the children's team.

Transportation under parental supervision

If the transportation of children is carried out in the presence of their parents, adoptive parents or guardians who are not accompanying the group, the rules for organized transportation of children by bus do not apply to it.

Organized transportation of children

Transportation rules imply:

  • Escort by representatives of the traffic police of buses with minors.
  • Compliance of the driver with the requirements of the rules.
  • Preparation of a set of documents for transportation.
  • Compliance with the requirements for accompanying persons.
  • Compliance with the rules of embarking / disembarking passengers in a vehicle.

Escort by representatives of the traffic police

Buses with children are accompanied by law enforcement officers only if they move in a convoy of three or more vehicles.

When transporting children, you must take a permit for the transport of children from an authorized representative of the automobile inspection. The original document is with the driver. At the first request of a traffic police officer, he must be provided.

Keep the originals of permits for 3 years from the date of transportation.

The organizers of the trip must submit a written application for escort to the district department of the State Traffic Inspectorate no later than two days before the planned trip. The document must indicate:

  • The time for which an escort is needed.
  • Number of children carried.
  • Full name of the accompanying person.
  • The route of movement.
  • Description of each bus with the obligatory indication of the state number, full name of the driver and registration data of his driver's license.

A written response is prepared and sent to the applicant.

If the transportation of children by one or two buses is organized, a notification of the upcoming trip is also sent to the traffic police department. The document must indicate:

  • Information about the company that organizes the transportation.
  • Transportation date.
  • Route with indication of the starting and ending points.
  • Number of children transported by age.
  • The brand of the bus and its state number.
  • Full name of the accompanying person.

The document must contain a notification from the traffic police that they are aware and do not interfere with the transportation of children. A notice or a copy of the application with the marks of the traffic police must always be with the bus driver.

We draw up documents

When organizing transportation, it is necessary to prepare the following documentation:

  • The contract of carriage signed by the customer and the transport company.
  • Agreement with a medical professional to accompany a group of children (if the movement of the column lasts more than 12 hours).
  • A copy of the permits for the carriage of children.
  • A copy of the application for support or notification from the traffic police.
  • A list of accompanying persons, indicating the full name, passport data and phone numbers.
  • List of transported children.
  • List of food items on the bus.
  • Information about drivers (full name, driver's license numbers, contacts).
  • Boarding document showing seat for each child.

Who draws up the landing document

  • Travel organizer.
  • The carrier's representative (if such a clause is spelled out in the contract).
  • Medical worker (the document takes into account the individual characteristics of each passenger).
  • Escort.

When specifying the route of travel, it is necessary to note:

  • Travel schedule with the time of movement.
  • Places of planned stops for rest, food and excursions (indicating organizations, hotels).
  • Stopping dates and times to meet the physiological needs of passengers.

Vehicle and driver requirements

Drivers will be allowed to carry children if:

  • They have driver's license from open category D.
  • Bus driving experience is at least 1 of the last 3 years.
  • During last year did not commit administrative offenses, they were not deprived of their rights.
  • They have passed the obligatory instruction on the transportation of children.
  • Received medical clearance for the flight.

Vehicle requirements

The new rules for transporting children by school bus, in terms of transport for transporting children, will take effect from 01.01.2017. They stipulate:

  • The obligatory presence of a technical coupon or a diagnostic card confirming the serviceability of the vehicle.
  • The bus for transporting children must be no older than 10 years from the date of issue.

Accompanying children

A group of children must be accompanied by an adult. Their responsibilities include:

The number of accompanying adults cannot be less than the number of doors on the bus. There must be one escort at each door during the journey. If there are more adults, one chief is appointed among them, who coordinates the work of the other accompanying persons.

Who can be allowed on the bus

The group is formed from children of different ages. For babies under 7 years old, there is a restriction - they can be on the road no longer than 4 hours. Otherwise, transportation of minors is prohibited.

Children who were previously included in the list by the leader will be allowed on the bus. In this case, before the start of the bus, the list can be changed by the head unilaterally. This means that the team leader or travel organizer can change the list without notifying the carrier.

Each driver is responsible not only for himself, but also for his passengers. If there are children in the car, then additional responsibility is imposed on the driver. Since 2016, there are new rules for the transportation of children, which we will talk about.

Any vehicle is designed in such a way that the built-in seat belts are effective only for passengers taller than 150 sentiments. When transporting children whose height is less than 150 centimeters, it is imperative to use a car seat, both in the back and in the front seat.

Many laws and a source indicate that children can be transported without a car seat from the age of 12, but this only means that children usually grow above 150 centimeters by this age and when transporting them, you can use the built-in seat belts. Clause 22.9

In the traffic rules of the Russian Federation there is clause 22.9. It regulates the rules for the transportation of children. Consider part 3 of article 12.23 of the Administrative Code:

Part 3 provides for a fine not only for the driver (3,000 rubles), but also for officials (25,000 rubles) and for legal entities (100,000 rubles). So, fines for officials and individual entrepreneurs relate to the organized transportation of children. In this case, the following violations of traffic rules may be allowed:

  • Transportation of children in the back of a truck with an onboard platform;
  • The number of children exceeds the number of seats;
  • The bus is not marked with signs "Carriage of children";

Fines for violation of the rules for organized transportation of children

Fines for violation of the rules for organized transportation of a group of children are provided for in part 4:

4. Organized transportation of a group of children by buses that do not meet the requirements of the Rules for the organized transportation of a group of children by buses, or by a driver who does not meet the requirements of these Rules, or without a charter agreement, if the presence of such a document is provided for by these Rules, or without a route program, or without a list of children, or without the list of appointed escorts provided for by the said Rules -

shall entail the imposition of an administrative fine on the driver in the amount of three thousand rubles; for officials - twenty five thousand rubles; for legal entities - one hundred thousand rubles.

Specified in this paragraph fines can be imposed for the following violations:

  • The bus is not equipped with GLONASS satellite navigation equipment;
  • More than 10 years have passed since the year of production of the bus (the requirement applies);
  • The bus is not equipped flashing beacon yellow or orange (the requirement applies from July 1, 2018);
  • The driver has not had continuous driving experience of category D during the last year;
  • During the last year, the driver has violated the rules, for which a punishment in the form of deprivation of rights or administrative arrest is provided;
  • The driver did not pass pre-trip instruction on the safety of transporting children
  • The driver did not pass;
  • There is no charter agreement;
  • There is no route program (a schedule with an estimated time of transportation and an indication of the places and times of stops);
  • There is no list of children (name, age);
  • There is no list of accompanying persons (name, phone number).

Please note that not only the driver is responsible for these violations:

  • 3,000 rubles - for the driver;
  • 25,000 rubles - for an official responsible for transportation;
  • 100,000 rubles - for a legal entity or individual entrepreneur engaged in transportation.

Those. in this case, an official of the organization must check the bus, driver and existing documents before the trip. Of interest is the requirement that the driver should not have violations that include administrative arrest or deprivation of rights as a punishment within the last year. This information is recorded in the traffic police, but is not displayed in any way in the driver's documents. Those. in practice, an official cannot verify violations and can only rely on the driver's honesty.

Penalty for transporting children at night

The fine for transporting children at night is provided for by part 5 of article 12.23 of the Administrative Code:

5. Violation of the requirements for the carriage of children at night, established by the Rules for the organized carriage of a group of children by buses, -

shall entail the imposition of an administrative fine on the driver in the amount of five thousand rubles or deprivation of the right to drive vehicles for a period of four to six months; for officials - fifty thousand rubles; for legal entities - two hundred thousand rubles.

Night time at means the time from 23:00 to 6:00. Night carriage is allowed only in the following cases:

  • Transportation to and from railway stations, airports;
  • Completion of the organized transportation of children at a distance of no more than 50 km.

If after 23 hours the bus travels a distance exceeding 50 km (it can be determined using a tachograph and GLONASS), then the traffic police have the right to impose the following fines:

  • 5,000 rubles or deprivation of rights for 4-6 months- for the driver;
  • 50,000 rubles - for officials;
  • 200,000 rubles - for legal entities.

The fines are very serious, even for the driver. This is due to the fact that transportation at night is extremely dangerous.

Violation of other rules for organized transportation

Part 5 of Article 12.23 of the Administrative Code:

6. Violation of the requirements for the carriage of children established by the Rules for the organized carriage of a group of children by buses, except for the cases provided for in parts 4 and 5 of this article, -

shall entail the imposition of an administrative fine on officials in the amount of twenty five thousand rubles; for legal entities - one hundred thousand rubles.

For other violations of the rules for organized transportation of children, the following fines are provided:

  • 25,000 rubles - for an official;
  • 100,000 rubles - for a legal entity.
