Russian legislation does not prohibit driving vehicle with different tires on the rear and front wheels.

Russian legislation does not prohibit the installation of different tires on the front and different tires on the same axle of the vehicle! Quite often, our compatriots combined summer tires with winter ones on their own vehicles. This is only permissible on a rear-wheel drive car, since the weight is evenly distributed in it. And in a car with front-wheel drive, this is not recommended, since in it almost all the weight is concentrated in front.

To avoid the occurrence emergency situations, experts advise to install the same tires on all wheels. If on the front and rear wheels different tires are installed in the car, this can lead to negative results.

Discrepancies in tire specifications, outer diameter or tread height can affect vehicle behavior. Under certain conditions, adhesion and abnormal performance may occur aBS systems and ESP. Fines for different tires

For drivers who do not adhere to the rules of the road, neglect personal safety and pose a threat to others, the state has developed special system restrictions and penalties in the form of fines. The size of the fines for the installation of different tires on the axles of the car are set by the traffic police in the form of 500 rubles. The traffic police officer is obliged to warn you about the need to replace the rubber with the same tread. The time intervals are not limited, if the owner of the motor transport vehicle prefers to continue driving on a car with different tires on the axles, at the next stop the driver will be again fined 500 rubles.


Novice motorists often look in the rules for the date when it is necessary to "change" the car, as well as the official justification for punishments for tires out of season. Traffic rules do not contain such information. But the operating conditions of tires, data on the winter version of tires and fines can be studied in the appendix to the Rules of the road.

A fine of 500 rubles. or a warning when checking on the road is regulated by the Code of Administrative Responsibility, which refers to Appendix No. 1 in the traffic rules.

Where is the tire change date indicated?

The period of operation of studded tires, winter friction rubber is in the Technical Regulations, which came into force in Russia since the beginning of 2015. The International Regulation, which has been joined by the member states of the Customs Union, indicates that tires with studs are summer period cannot be used. Winter tires need to bet on winter period (from December 1 to February 28 (29)), and the use of friction tires (in common parlance "velcro") is allowed at any time of the year.

Traffic police officers are not entitled to punish for tires inappropriate for the season, since Russian legislation does not provide for sanctions for operating a car in summer tires in winter and vice versa. However, there are norms according to which a driver can be fined for worn out tread, deformation of tires, disks.

Traffic rules on the condition of tires, disks

In 2018, the Traffic Rules with Appendix No. 1 "List of faults and conditions under which the operation of vehicles is prohibited" is relevant. The fifth paragraph regulates the permissible depth of the tread pattern and deformation, in which the use of transport entails the risk of an accident for all road users. This item causes the application of penalties in the amount of 500 rubles. The motorist can also simply be warned about the inadmissibility of using a car in an improper condition.

Depth of tread pattern

Tread depth measurement is required if no indicator is available. If it is provided by the tire design, then the wear is determined by it. Tread depth set in traffic rules:

  • for motorcycles, mopeds - 0.8 mm;
  • for cars and trucks with a carrying capacity of less than 3.5 t - 1.6 mm;
  • for trucks (from 3.5 t) - 1 mm;
  • for buses and route transport, in which there are more than 8 passenger seats - 2 mm.

Such indicators are set for road surface without snow and ice. In conditions of ice and snow cover, the tread depth must be at least 4 mm. If the indicator is 3.5 mm or less, then a penalty is provided - a fine of 500 rubles.

Which tires are considered winter tires?

Since the tire assortment includes several seasonal varieties, the characteristics of winter tires were prescribed in the traffic rules. This is a special marking (three-peaked top with a snowflake, Latin letters M S), the tread depth is at least 4 mm. For universal tires in winter, these rules are also relevant. By purchasing the kit all season tires, it is worth clarifying the presence of markings, otherwise a fine may be issued on an icy track during a check.

Traffic police officers have the right to fine the driver if a wear indicator is visible on the tire. Studded tires can only be used from December to February, the wear rate is the same for it.

What violations of tire operation are prescribed in the rules?

The application provides that you cannot operate a car if:

  • there is damage to the tires, exposing the cord;
  • the protector or sidewall is peeling;
  • there is no fastening bolt (nut);
  • the cord is delaminated;
  • there are cracks in the disc or rims;
  • the shape (size) of the mounting holes is broken;
  • there is a discrepancy (in size, load) of the tire model of the car.

It is forbidden to install tires of different sizes on one wheel axle:

  • size, design, model, tread pattern;
  • degree of deterioration (new and worn out, new and refurbished)
  • seasonal characteristics (for summer and for winter).

If the vehicle is equipped with studded tires, they must be on all wheels.

Examples of violations of traffic rules that relate to tires

  • One car has winter (with markings) and summer (unmarked) tires.
  • The pattern of sipes on the tread of tires located on the same axle is different.
  • There are studded tires on the front axle, and friction tires on the rear.

The fine for such a violation is 500 rubles, the basis is the Code of Administrative Offenses (Article 12.5).

Vehicle owners are not always able to minimize vehicle costs, often saving on components and consumables.

By cutting costs and striving to profit from the operation of the car, they even turn a blind eye to safety. You can get a fine from a traffic police officer without even breaking traffic rules for overtaking, speeding or crossing an intersection.

Situations when unequal tires are installed on the axles are considered dangerous. Many do not even know if it is possible to put different tires on different axes according to traffic rules in 2019.

Can I ride different tires?

Traffic rules regulate the use of tires on a vehicle... Clause 5.5 of the SDA states that the installation of tires with different tires on one axle of vehicles is prohibited. The law has been in effect since 2010 and is valid until today.

According to clause 5.5, the operation of transport is prohibited if one axle is equipped with:

  • models with different tread patterns;
  • tires of various sizes and designs (tube and tubeless, radial and bias);
  • new and remanufactured with different tread;
  • frost-resistant and frost-resistant;
  • new tires with a tread groove;
  • studded and non-studded tires.

This clause does not completely prohibit the use of different tires on the front and rear axles of a car, except for the simultaneous use of studded and non-studded tires.

Such an installation is definitely prohibited, it is absolutely impossible to combine them. All 4 tires on the machine must be studded or non-studded.

On the one hand, this prohibition is useful, since motorists often take the issue of safety into the background, reducing the cost of car maintenance. A vehicle equipped with different tires on the same axle may behave unpredictably when braking.

This situation is especially dangerous in rain or ice on a slippery road. Only the driver will be to blame for the sad consequences.

For example, if your car has one dry tire and the other wheel is designed to prevent aquaplaning. When it rains, one wheel will skid, while the other will be stable on the road surface.

A fine of 500 rubles can threaten not only for different tires... Although the classification of rubber is not in the traffic rules, but according to the current norms of international standards (Technical Regulations of the Customs Union), motorists who did not have time to change one type of rubber to another can be punished.

Winter tires are supposed to be installed on all wheels of vehicles... If one of the tires has become unusable, and you cannot find a replacement for it, then you can buy two identical tires and install them on one of the axles of the car.

At the same time, tires can vary significantly on different axles. The ban applies only to the installation of non-studded winter tires on the front axle of a car, and ordinary summer tires on the rear axle.

All tires on the car must be either summer or winter.

Ideally, tires should be matched with a minimum of differences.... If one of the winter tires is damaged, then the best option will buy a pair of winter tires by fitting them to one of the axles. Although there will be different winter tires at the front and rear, this is not a violation.

A bill is currently being discussed in favor of toughening the use of off-season tires. If adopted, car owners with the wrong tires may be fined 2,000 rubles.

It is possible that the owner of the vehicle was stopped at the moment when he was driving to the service station to change tires. If it was not possible to convince the employee of this orally, then his explanations must be entered into the protocol on the violation.

If you have to dispute a fine, then this testimony will come in handy. You can also express your doubts about the correct measurement of the tread length.

If you were nevertheless handed a sanction order, you can pay a fine within 2 months or appeal it in court within 10 days if you have doubts about the legality of the inspector's measures.

You should also know that you can appeal against a court decision.... If the court rejects your case, you will have to pay the amount written out.

Therefore, car owners should be more attentive to the requirements for tires on wheels. In addition to monetary sanctions, this is important for your own and other people's safety on the roads.

If you have different tires in the front and rear, you are using the car legally... The legislation does not say anything about this, there are no prohibitions.

Since the characteristics of the wheels are almost the same, the vehicle should not pull to the sides, but there are still some nuances.

In order for the car to be able to better hold the road in the rain, the front and rear pairs of wheels must still have similar characteristics.

Previously, it was often practiced to combine summer and winter tires... Tires were installed on the rear axle of a machine with a classic drive winter typewhile summer tires remained on the front axle.

On four-wheel drive vehicles important components and the engine are located under the bonnet, so the bulk is diverted to the front.

If the car owner puts winter tires on the front of the car, then the car will perfectly keep the icy road in front, but the rear of your vehicle will dangle. This can lead to skidding of the vehicle, which is completely unsafe.

Although the law does not provide for a fine for different tires on the axles, you should still think about safety on the road. Installing wheels with different profile heights and from different manufacturers, we recommend that you make a minimum gap between the rubber diameter.

If, when inspecting vehicles by an inspector, an installation of rubber with a different size on one axle is found, then you will be required to pay a fine for different tires on one axle in the amount of 500 rubles.

To avoid paying this amount, you can tell the traffic police officer that you just punctured the wheel and are heading to the maintenance station. But do not abuse this behavior, it will be much easier to replace the wheel on the axle, avoiding the problem.

Is it possible to put tires with different patterns on different axles and is this allowed?

Sometimes car owners install tires with different tread patterns on different axles.... In the Code of Administrative Offenses of the Russian Federation, there are no directly specified norms regarding the punishment for different tires on different axles.

Operation of the vehicle is permitted if there are two identical tires on the front axle of the vehicle, and two identical tires on the rear axle. The two front tires may have a different pattern from the two rear tires.

It is enough to buy two identical tires and install them on one axle... Thus, you will save a little, but also there will be no problems with emergency braking due to the difference in tread patterns.

Is it allowed to install tires with different tread patterns on the same axle?

If the tires have different tread patterns, the operating conditions of the car are violated, and this is not at all safe.

In clause 5.5. the corresponding norm is spelled out, and gives a reason for the traffic police to fine the driver 500 rubles or give him a warning.

Only identical tires should be installed on one axle of the car.

You cannot use different tires on the same axle, however, tires with different wear on the same axle are not subject to restrictions.

If your vehicle has damaged two left wheels, then you can install the remaining right tires on one of the axles, and a pair of new tires on the other axle.

The ban is imposed on the use of new and retreaded tires, as well as new tires and tires with a deep tread pattern:

  1. Reclaimed rubber Is when completely worn out tire sent to the factory, and there a new layer of rubber with a tread is applied to it.
  2. Deepening the tread pattern - this is when with the help of special equipment grooves are deepened on the tire, that is, a new tread is cut out.

Such recessed and remanufactured tires cannot be used simultaneously with new ones.

It would seem that a little over a year has passed since the heated debate about the mandatory use of seasonal tires on cars and fines for driving on summer tires in winter. Now many drivers are looking for information about the so-called law on winter tires, in accordance with which amendments are made to traffic rules.

IMPORTANT:

Many drivers ask a question: there was a rumor that from December 1, 2017, those who did not change summer tires to winter ones will be fined. Is it so?

For now, the answer is:

At the moment, the State Duma of the Russian Federation is considering a bill on the introduction of administrative fines in the amount of 2 thousand rubles for using car tires out of season. In the case of its prompt adoption, already from December 1, 2017, a driver who violates the rules for using tires according to the season may be fined.

But so far there are no grounds for bringing to administrative responsibility those drivers who did not have time to change tires!

At the same time, I would like to advise car owners to show their experience and prudence: do not wait for a "command from above", but "change shoes" on time - depending on the climatic conditions of your region.

We analyze the law on winter tires (about which the decree No. 588 and the technical regulation TR CU 018/2011)

The decree # 588 itself does not say a word about the need for the mandatory use of seasonal tires. It only changes the conditions for admitting a vehicle to operation (by the decree from January 1, 2015, Appendix 5.1 to the main provisions on the admission of wheeled vehicles to operation is changed).

The main innovation is the minimum tread depth for different types tires on different vehicles in the absence of a factory wear indicator. When a wear indicator is provided on the tires, the fact of wear is established by it.

So, for passenger cars the minimum tread depth of a summer tire is set to 1.6 mm.

However, by decree introduced as the very concept of winter tires (marking "M + S", "M & S", "M S", as well as a pictogram in the form of a three-peaked top with a snowflake in the center), and the minimum tread depth for it, equal to 4 mm.

For other vehicles, the restrictions look like this:

  • Motorcycles, mopeds, ATVs, etc. (category L) - 0.8 mm;
  • Trucks with licensed maximum mass more than 3.5 tons (categories N2, N3, O3, O4) - 1 mm;
  • Passenger cars (categories M1, N1, O1, O2) - 1.6 mm;
  • Buses (categories M2, M3) - 2 mm.

In addition, the rubber should not be damaged - various side cuts, abrasions to the cord or uneven wear. But the requirements for rims are a thing of the past - previously, the rims should not have had cracks, traces of welding, damage, deformation of the mounting holes, etc.

5. Wheels and tires

5.1. The residual depth of the tire tread pattern (in the absence of wear indicators) is no more than:

for vehicles of categories N2, N3, O3, O4 - 1 mm;

for vehicles of categories M1, N1, O1, O2 - 1.6 mm;

for vehicles of categories M2, M3 - 2 mm.

Penalty for mismatching tires

The fine is set at 500 rubles (clause 1 of article 12.5 of the Administrative Code of the Russian Federation).

“Article 12.5. Driving a vehicle in the presence of malfunctions or conditions under which the operation of vehicles is prohibited, or a vehicle on which the identification mark "Disabled" is illegally installed

Seasonality of tires

But in the document described above there is not a word about the seasonality of the rubber used, unless, of course, the very definition of winter tires is taken into account.

However, the requirements for the use of seasonal tires are really introduced from January 1, 2015 on the basis of technical regulations Customs Union TR CU 018/2011 "On the safety of wheeled vehicles" ().

Excerpt from the regulations:

5.4. Spiked tires, if used, must be fitted to all wheels of the vehicle.

5.5. It is prohibited to operate vehicles equipped with tires with anti-skid studs during the summer period (June, July, August).

It is prohibited to operate vehicles that are not equipped with winter tires that meet the requirements of paragraph 5.6.3 of this Appendix during the winter period (December, January, February). Winter tires are installed on all wheels of the vehicle.

The terms of the prohibition of operation can be changed upwards by the regional government bodies of the member states of the Customs Union.

5.6. A tire is considered unfit for use when:

5.6.1. The appearance of one wear indicator (a protrusion along the bottom of the tread groove, designed to visually determine the degree of its wear, the depth of which corresponds to the minimum permissible depth of the tire tread pattern);

5.6.2. Remaining depth of tire tread pattern (in the absence of wear indicators) no more than:

for vehicles of categories L - 0.8 mm;

for vehicles of categories N2, N3, O3, O4 - 1.0 mm;

for vehicles of categories M1, N1, O1, O2 - 1.6 mm;

for vehicles of categories M2, M3 - 2.0 mm.

5.6.3. The residual tread depth of winter tires designed for operation on icy or snow-covered road surfaces, marked with a sign in the form of a mountain peak with three peaks and a snowflake inside it (Figure 5.1), as well as marked with signs “M + S”, “M&S”, “ MS "(in the absence of wear indicators) during operation on the specified surface - no more than 4.0 mm;

This regulation establishes the need to use:

  • During the calendar winter (December-February inclusive) - winter tires;
  • In the summer period (June-August inclusive) - summer tires;
  • The rest of the time, the tires used are not regulated.

The concept of all-season tires is simply not included in the new regulation. However, they will be interpreted as summer in summer, and, accordingly, winter in winter.

But there are requirements, but there is no punishment for non-fulfillment yet. Those. a fine for driving in winter on summer tires (or vice versa) is not provided (yet).

What is this all for

In theory, lawmakers care about user safety road transport... The fact is that, statistically, most of the road accidents are associated with low-quality (worn out, off-season, etc.) rubber. Therefore, they are trying to establish order in this area.

However, in the end it turned out to be a rather soft innovation, which practically does not change the situation.

As for the destruction of the road surface by studded tires, the situation here is regulated through the rubber manufacturers themselves, where the factor of destruction of the coverage by studs is now regulated by standards. therefore the choice of studded or non-studded winter tires remains with the car owner.

Will there be a penalty for riding summer tires in winter?

Considering that only half measures have been taken, it should be assumed that in the future the requirements will be tightened. Already now, the State Duma of the Russian Federation is receiving news that in the very near future a fine for driving on summer tires in the amount of 2,000 rubles will be introduced. However, this bill is still only being discussed and finalized, and when it comes into force is not yet known.

Difficulties in the introduction are caused by the different climatic zones, as well as the general unpredictability of the weather. It is also possible to introduce restrictions on the actual weather condition. At the same time, it is not clear how to behave if the path is long, through many climatic zones. Carry with you additional kit tires?

But while all this is not there, it makes no sense to reason. In the meantime, it is important to monitor the condition of the tires themselves, depending on their type.

Is the driver obliged to use seasonal tires?

A ridiculous (ha-ha!), It would seem, a question! After all, it is well known that the technical regulations of the Customs Union (TR CU 018/2011), which came into force on the territory of the Russian Federation, requires the use of winter tires in the winter period (from December to February), and summer tires in the summer (from June to August).

In addition, there is the possibility of expanding this chronological framework. For example, if a more detailed account of regional climatic features is required. (Well, really, how can you put in the same row, for example, Murmansk and Krasnodar? How can you require the same timing for winter tires for fundamentally different climatic zones).

And here the most natural driver's question arises: "How will those who ignore this requirement of the technical regulations be punished?" We will boldly answer: "Not yet!" That is, there is a requirement, but failure to comply with it will not lead to sanctions (for example, a fine). We do not know what will happen next. But for now? As they say, walk bye!

Another Russian paradox?

Let's make a reservation right away: there is nothing paradoxical in this! The practice of the Russian legal field has the following examples:

  • “Kenguryatniks” cannot be established, and there are no penalties for this;
  • the sign "Novice driver" must be glued, but there is no responsibility for non-compliance with this requirement;
  • the maximum speed of movement cannot be exceeded, but at 20 km / h in reality it is possible, etc., etc., etc.

Normal legal "collisions" and "gaps".

That is why on the claim of the inspector about the inconsistency of the "shoes" of your car with the notorious technical regulations, you can culturally send him to ... this very paradoxical situation. Namely: the Code of Administrative Offenses of the Russian Federation does not provide for punishment for violation of the norms of an international normative legal act - technical regulations.

And that's it! The conversation with the inspector can be ended with the following words: “Allow me, gr. Inspector, keep driving! Be healthy, you have more stars and shoulder straps in two gaps! " (the last sentence is optional).

Why are we, the drivers, alarmed?

And yet the possibility of punishment associated with the innovation is present. In the famous "List of faults ...", with which the operation of transport is prohibited, two amendments were made - one insignificant and the second, on the contrary, important. And both changes affected only the first point 5 of the "List ..." section.

A minor change concerns the treads of summer tires. Now the residual tread height differs not by the types of vehicles - cars, trucks, etc. (as it was before), but by categories - L, M, N, O (in accordance with the notorious technical regulations).

For example, for cars (M1) and trucks with a RMM of not more than 3.5 t (N1), the residual tread height must be at least 1.6 mm, for "real" trucks (N2, N3) - 1 mm, buses (M2, M3) - 2 mm, motorcycles and others like them (L) - 0.8 mm. As can be seen from the innovations, the form, but not the content of the requirements has changed.

But a significant innovation is the newly introduced requirements for winter tires. If the driver has changed his car into winter tires with appropriate labeling (an abbreviation for "mud and snow" or the image of a three-peaked mountain peak with a snowflake), then the minimum tread height should be no less than 4 mm. True, there is a variant with special wear indicators that should not be subject to mechanical damage from exploitation.

In case of violation of the 4-mm residual height of the tread, the driver must be held liable under the Code of Administrative Offenses of the Russian Federation - a 500-ruble fine. But there is also a big "BUT" here ...

Who will control and punish for violation of the notorious 4 millimeters?

This is the question! Let's set it in a different way: will the traffic police inspector be able to fine the driver if the residual height of the winter tread of his car's tires is less than 4 mm?
