When to legalize winter tires


The Wheeled Vehicle Safety Regulation contains a strict definition of when winter or summer tires must be fitted to a vehicle.
According to the law, in the summer months (June, July and August), you can use any rubber on the car, except for studded tires, since it has a negative effect on the road surface. During the winter months (December, January and February), only tires that are designed for winter can be used, while both studded and non-studded tires can be used.

Please note: For use during the winter months in Russian Federation only tires with the following designations are allowed:M +S,M &S orMS. These markings indicate that the tires are intended for winter use. In this case, similar designations may be present on all season tiresah, then their operation in the winter is permitted. If the all-season tires do not have this mark, they cannot be used in winter.

It should be noted that regional authorities have the right to change the terms of use seasonal rubber... For example, regional government decrees may require the use of winter tires from October to April. There is a widespread belief that a driver will be fined for using summer tires in winter. Throughout 2015, motorists have been discussing a new bill on how winter tires should be used. The law is passed or not, many drivers still do not know. That is why it is important to understand this issue. Moreover, the violation traffic rules shall entail the imposition of fines.

Winter tires law

First of all, you should understand what this law is about changing rubber to winter and what are its main provisions. It is important to know what is called the Technical Regulations of the Customs Union, which was adopted on January 1, 2015. It sets out the requirements for the safe use of transport.

From now on, it is forbidden to use tires designed for winter driving and equipped with studs in summer. And, on the contrary, it was forbidden to ride summer wheels in winter. At the same time, the legislation establishes the requirement that all wheels must be replaced at the same time.

However, the law on winter tires also has a large number of shortcomings. One of the most significant is the fact that there are no articles in it that would impose requirements on tires used on freight transportas well as on buses.

In addition, it is not entirely clear how the compliance of rubber with the requirements specified in the law will be checked. Only points technical inspection... However, new cars are exempt from this obligation.

Why you should change tires on time

Understanding when to fit winter tires according to the law, you need to understand why it is so important to comply with the requirements of this regulation. The main goal of the development of the Technical Regulations is to improve safety road traffic.

Untimely installation of winter tires can lead to a number of problems:

  • increasing the braking distance significantly increases the likelihood of accidents;
  • a decrease in the speed of movement leads to the formation of congestion on the roads;
  • the car is stalled, because they cannot overcome even not too steep climbs.

Wheel operating rules

The Winter Tire Law sets out certain rules for the use of tires:

  1. In summer, it is forbidden to use rubber that is equipped with spikes. The ban period runs from June to August.
  2. In winter, from December to February, you must not drive vehicles that are not equipped with winter tires.
  3. Special non-studded rubber (so-called Velcro) can be used all year round. It must be marked accordingly with the letters M and S.
  4. Local authorities have the right to change the terms of use depending on the climate different types rubber. They can only be changed upwards.
  5. Tread depth in winter time should be at least 4 mm, and in the summer - 1.6 mm.

Types of winter tires

There are usually two types of winter rubber - with spikes and Velcro. Each of these types of tires has its own advantages and disadvantages.

Such tires can be said to stick to the road surface. They are best suited for use in regions with a non-severe climate, as well as in urban environments. However, the Velcro is longer than in addition, they show themselves worse on ice and snow.

The safest is considered to be rubber with spikes. They are great for extreme frosts. At the same time, the excellent grip of the studded wheels with the road can significantly reduce braking distances... Such rubber performs well on icy roads, as well as covered with wet snow. Such wheels have much worse performance when operating on wet asphalt. However, such wheels also have disadvantages. They are quite heavy and when driving on high speed make a lot of noise. In addition, the studs wear off very quickly, and fuel consumption increases during their operation.

Service life of tires

An important requirement is not only that, it is also important by law that the tread depth is required level... Therefore, you need to know how long you can use and how to increase the service life of tires.

It is impossible to calculate how long the tread will become unusable. This can only be determined during use. Studded tires wear out the fastest. They can be used for no more than three seasons. Velcro can last much longer. All season tires will last the longest. However, they should not be used in extreme weather conditions such as extreme heat or frost.

Thus, it is impossible to predict how long a tire will go to inconsistency with the law. However, there is a way to extend their useful life. To do this, do not ride on wheels that are out of season.

Tire category confirmation

As for the so-called all-season tires, there is no information in the law on how to certify such tires. But the manufacturers have found a way out - they issue two categories of certificates for the same tires. One confirms the possibility of their use in summer, the other - in winter.

What kind of rubber was outlawed?

It's no secret that car tires with spikes spoil the road surface. That is why standards have been established on how many studs winter tires should contain. Russia supported this law.

The only difference is the number of studs per running meter. In Europe, the size of this indicator is allowed at 50. In Russia, it was increased by 10.

When to change tires?

If you remember the rules for the operation of wheels, established in regulatory enactments, the question, according to the law, will be automatically removed. To avoid disagreements with the traffic police, this must be done before December 1. Back tires should be reinstalled by June 1st.

But don't forget about safety requirements. In accordance with them, it is not always expedient to have the administratively established period in which the transition to winter tires is carried out.   • Winter tires should be installed when the road has been covered with ice several times. Punishment for non-compliance with the requirements of the law

Those who do not comply with the law on winter tires will not be punished. The fact is that at the moment fines for untimely replacement tires do not exist.

Nevertheless, the Code of Contraventions established that when using worn out car tires the car owner faces:

  • warning from the traffic police officer;
  • a fine of 500 rubles.

To determine the correct procedure for changing a winter tire to a summer one, it is necessary to determine the exact date. Nobody can name her. Passenger car regulations

The main provisions of the law that determine the rules for the transition from winter to summer tires in cars are as follows:

  • On January 1, 2015, amendments to the law regarding the term "winter tires" and its detailed meaning came into force. The amended articles refer to the permissible tread depth. However, about seasonal tires while driving on vehicle not said;
  • Penalties for a shift are permitted by law if the regulations of Part 1 of Article 12.5 of the Administrative Code of the Russian Federation have been violated. The procedure for changing tires for trucks

Changes in the timing of tire change in accordance with the law will affect and trucks... Regional authorities independently determine the period during which only one type of wheel can be used. At the same time, experts argue that deadlocks cannot be avoided.

For example, in order for a truck driver to cover the distance from Sochi to Murmansk, he must change from one type to another several times. Legislative experts are proposing changes to the law, which will determine the exact date of tire change.

You should also change the truck tires if they are unsuitable for subsequent use. There is a procedure for determining the indicators of tire change:

  • Jumpers are visible on the tread;

If at least one of the above requirements does not comply with the norms of the law, the rubber for trucks needs to be changed.

Terms of wheel replacement by law

In 2017, a bill was passed. Now car owners are obliged to change their wheels at the strictly allotted time - December 1. But if a tire change has already been carried out before that date, this is not considered a violation of the law. You can move on a winter tread until March 1. Upon its occurrence, the vehicle can be changed. However, in some regions of Russia, it is recommended to change your shoes on March 1 or later. By this number, weather conditions become more resistant to changes.

Penalties

It should be noted that there are no penalties for summer tires. This provision is absent in the Federal Law. Therefore, rumors that punishment is imposed for an untimely shift are refuted.

If we are talking about the punishment for driving on winter tires in the summer, here, during the development of the project, it was planned to fine up to 2,000 rubles. However, the initiative was not confirmed by the State Duma. According to the Code of Administrative Offenses, you can only be fined for non-compliance with the fine technical requirements according to law. Size - 500 rubles.

Is it possible to ride summer tires in winter?

No, this is prohibited. This prohibition is regulated by the Technical Regulations of the Customs Union in its clause 5.5 in their "requirements for vehicles in operation" (Appendix 8 of the regulation). At the same time, this normative act clearly regulates the winter and summer months. The former are December, January and February, the latter are June, July and August.

At the same time, these months may differ if any region of Russia establishes its own rules, which is quite logical; and only in the direction of increase, which ... is completely illogical. Indeed, in the same Krasnodar Territory, winter tires may not be required at all. But alas, this is the law!

5.5. It is prohibited to operate vehicles equipped with tires with anti-skid spikes in the summer period (June, July, August).
It is prohibited to operate vehicles that are not equipped with winter tiressatisfying the requirements of paragraph 5.6.3 of this annex, in winter (December, January, February)... Winter tires are installed on all wheels of the vehicle.
The terms of the prohibition of operation can be changed upwards by regional authorities state administration of the states - members of the Customs Union.

Thus, it is forbidden to ride summer tires in winter - in December, January and February (the terms may vary by regions). It is not necessary to change your shoes to winter tires from October 1 and November 1.

Where can I find out about the increase in the ban in my city?

Alas, there is no way to unequivocally answer this question. For 2019, not a single region and city has changed the provisions of the Technical Regulations regarding summer tires in winter.

It would seem that a little more than a year has passed since the heated debate about the mandatory use of seasonal tires on cars and fines for driving on summer tires in winter. Now many drivers are looking for information about the so-called law on winter tires, in accordance with which amendments are made to traffic rules.

Although Resolution of the Government of the Russian Federation No. 588, amending the Road Traffic Regulations concerning the use of tires from January 1, 2015, was adopted on July 15, 2013 ("Rossiyskaya Gazeta" is the official website where you can read the text of the amendments introduced by this Resolution No. 588).

Many drivers ask a question: there was a rumor that from December 1, 2017, those who did not change summer tires to winter ones will be fined. Is it so?

For now, the answer is:

At the moment, the State Duma of the Russian Federation is considering a bill on the introduction of administrative fines in the amount of 2 thousand rubles for using car tires out of season. In the case of its prompt adoption, already from December 1, 2017, a driver who violates the rules for using tires according to the season may be fined.

But so far there are no grounds for bringing to administrative responsibility those drivers who did not have time to change tires!

At the same time, I would like to advise car owners to show their experience and prudence: do not wait for a "command from above", but "change shoes" on time - depending on the climatic conditions of your region.

We analyze the law on winter tires (about which the decree No. 588 and the technical regulation TR CU 018/2011)

The decree # 588 itself does not say a word about the need for the mandatory use of seasonal tires. It only changes the conditions for admitting a vehicle to operation (by the decree from January 1, 2015, Appendix 5.1 to the main provisions on the admission of wheeled vehicles to operation is changed).

The main innovation is the minimum tread depth for different types tires on different vehicles in the absence of a factory wear indicator. When a wear indicator is provided on the tires, the fact of wear is established by it.

So, for passenger cars the minimum tread depth of a summer tire is set to 1.6 mm.

However, by decree introduced as the very concept of winter tires (marking "M + S", "M & S", "M S", as well as a pictogram in the form of a three-peaked top with a snowflake in the center), and the minimum tread depth for it, equal to 4 mm.

For other vehicles, the restrictions look like this:

  • Motorcycles, mopeds, ATVs, etc. (category L) - 0.8 mm;
  • Trucks with licensed maximum mass more than 3.5 tons (categories N2, N3, O3, O4) - 1 mm;
  • Passenger cars (categories M1, N1, O1, O2) - 1.6 mm;
  • Buses (categories M2, M3) - 2 mm.

In addition, the rubber should not be damaged - various side cuts, abrasions to the cord or uneven wear. But the requirements for rims are a thing of the past - previously, the rims should not have had cracks, traces of welding, damage, deformation of the bore holes, etc.

An excerpt from the list of faults and conditions under which the operation of vehicles is prohibited (Appendix No. 3 to the traffic rules of the Russian Federation), taking into account the amendments introduced from January 1, 2015:

5. Wheels and tires

5.1. The residual depth of the tire tread pattern (in the absence of wear indicators) is no more than:

for vehicles of categories N2, N3, O3, O4 - 1 mm;

for vehicles of categories M1, N1, O1, O2 - 1.6 mm;

for vehicles of categories M2, M3 - 2 mm.

5.2. Tires have external damage (punctures, cuts, breaks), exposing the cord, as well as delamination of the carcass, peeling of the tread and sidewalls.

5.4. Tires by size or permissible load do not match the vehicle model.

Penalty for mismatching tires

The fine is set at 500 rubles (clause 1 of article 12.5 of the Administrative Code of the Russian Federation).

Seasonality of tires

But in the document described above there is not a word about the seasonality of the rubber used, unless, of course, the very definition of winter tires is taken into account.

However, the requirements for the use of seasonal tires are actually introduced from January 1, 2015 on the basis of technical regulations Customs Union TR CU 018/2011 "On the safety of wheeled vehicles" ().

5.4. Spiked tires, if used, must be fitted to all wheels of the vehicle.

5.5. It is prohibited to operate vehicles equipped with tires with anti-skid spikes in the summer period (June, July, August).

It is prohibited to operate vehicles that are not equipped with winter tires that meet the requirements of paragraph 5.6.3 of this Appendix during the winter period (December, January, February). Winter tires are installed on all wheels of the vehicle.

The terms of the prohibition of operation can be changed upwards by the regional government bodies of the member states of the Customs Union.

5.6. A tire is considered unusable when:

5.6.1. The appearance of one wear indicator (a protrusion along the bottom of the tread groove, designed to visually determine the degree of its wear, the depth of which corresponds to the minimum permissible depth of the tire tread pattern);

5.6.2. Remaining depth of tire tread pattern (in the absence of wear indicators) no more than:

for vehicles of categories L - 0.8 mm;

for vehicles of categories N2, N3, O3, O4 - 1.0 mm;

for vehicles of categories M1, N1, O1, O2 - 1.6 mm;

for vehicles of categories M2, M3 - 2.0 mm.

5.6.3. The residual tread depth of winter tires designed for operation on icy or snow-covered road surfaces, marked with a sign in the form of a mountain peak with three peaks and a snowflake inside it (Figure 5.1), as well as marked with signs “M + S”, “M&S”, “ MS "(in the absence of wear indicators) during operation on the specified surface - no more than 4.0 mm;

This regulation establishes the need to use:

  • During the calendar winter (December-February inclusive) - winter tires;
  • In the summer period (June-August inclusive) - summer tires;
  • The rest of the time, the tires used are not regulated.

The concept of all-season tires is simply not included in the new regulation. However, they will be interpreted as summer in summer, and, accordingly, winter in winter.

But there are requirements, but there is no punishment for non-fulfillment yet. Those. a fine for driving in winter on summer tires (or vice versa) is not provided (yet).

Why all this

In theory, lawmakers care about user safety road transport... The fact is that, statistically, most of the road accidents are associated with low-quality (worn out, off-season, etc.) rubber. Therefore, they are trying to establish order in this area.

However, in the end it turned out to be a rather mild innovation that practically does not change the situation.

As for the destruction road surface studded tires, here the situation is regulated through the rubber manufacturers themselves, where the factor of destruction of the coating by studs is now regulated by standards. therefore the choice of studded or non-studded winter tires remains with the car owner.

Will there be a penalty for riding summer tires in winter?

Considering that only half measures have been taken, it should be assumed that in the future the requirements will be tightened. Already now, the State Duma of the Russian Federation is receiving news that in the very near future a fine will be introduced for driving in winter on summer tires in the amount of 2,000 rubles. However, this bill is still only being discussed and finalized, and when it comes into force is not yet known.

Difficulties in the introduction are caused by the different climatic zones, as well as the general unpredictability of the weather. It is also possible to introduce restrictions on the actual weather condition. At the same time, it is not clear how to behave if the path is long, through many climatic zones. Carry with you additional kit tires?

But while all this is not there, it makes no sense to reason. In the meantime, it is important to monitor the condition of the tires themselves, depending on their type.

Is the driver obliged to use seasonal tires?

A ridiculous (ha-ha!), It would seem, a question! After all, it is well known that the technical regulations of the Customs Union (TR CU 018/2011), which came into force on the territory of the Russian Federation, requires the use of winter tires in the winter period (from December to February), and summer tires in the summer (from June to August).

In addition, there is the possibility of expanding this chronological framework. For example, if a more detailed account of regional climatic features is required. (Well, really, how can you put in the same row, for example, Murmansk and Krasnodar? How can you require the same timing for winter tires for fundamentally different climatic zones).

And here the most logical driver's question arises: "How will those who ignore these requirements of the technical regulations be punished?" We will boldly answer: "Not yet!" That is, there is a requirement, but failure to comply with it will not lead to sanctions (for example, a fine). We do not know what will happen next. But for now? As they say, walk bye!

Another Russian paradox?

Let's make a reservation right away: there is nothing paradoxical in this! The practice of the Russian legal field has the following examples:

  • “Kenguryatniks” cannot be established, and there are no penalties for this;
  • the sign "Novice driver" must be glued, but there is no responsibility for non-compliance with this requirement;
  • the maximum speed cannot be exceeded, but at 20 km / h in reality it is possible, etc., etc., etc.

Normal legal "collisions" and "gaps".

That is why on the claim of the inspector about the inconsistency of the "shoes" of your car with the notorious technical regulations, you can culturally send him to ... this very paradoxical situation. Namely: the Code of Administrative Offenses of the Russian Federation does not provide for punishment for violation of the norms of an international normative legal act - technical regulations.

And that's it! The conversation with the inspector can be ended with the following words: “Allow me, gr. Inspector, keep driving! Be healthy, you have more stars and shoulder straps in two gaps! " (the last sentence is optional).

Why are we, the drivers, alarmed?

And yet the possibility of punishment associated with the innovation is present. In the famous "List of faults ...", with which the operation of transport is prohibited, two adjustments were made - one insignificant and the second, on the contrary, important. And both changes affected only the first paragraph 5 of the "List ..." section.

A minor change concerns the treads of summer tires. Now the residual tread height differs not by the types of vehicles - cars, trucks, etc. (as it was before), but by categories - L, M, N, O (in accordance with the notorious technical regulations).
