The truck body must meet the following requirements:

The sides and seats must be smooth without protruding sharp parts. For boarding (disembarking) people, the body is equipped with a ladder, which is attached from the side of the tailgate, on the right side relative to the movement.

Side locks must be closed and additionally fixed to prevent accidental opening while driving.

A mandatory requirement is the presence of a fire extinguisher (with a capacity of 2 liters or more) and a first aid kit in the body.

Before boarding a body equipped for transportation, a body supervisor or a truck driver is instructed on the rules for boarding, placing and disembarking, as well as the rules of behavior while driving.

Boarding and disembarking are allowed only from the sidewalk, if there is no movement vehicle... All movements of passengers can occur only during a stop, with the permission of the body supervisor. The number of passengers cannot exceed the number seats.

In the back of the truck, the civil transport of children is strictly prohibited.

When transporting people in the back of a truck, there are several restrictions:

  • in the car, adults must be fastened with seat belts, and for those who are under 12 years old, you should have special restraints (chairs, etc.);
  • when moving an organized group of children in a vehicle, an appropriate sign is required.

Under what conditions is the carriage of passengers prohibited?

When the carriage of passengers by road is prohibited, it is said in subsection 22.8 of the traffic rules of the Russian Federation:

  • you must not put people outside the cab of the car, if it is not an equipped truck with a flatbed or a box body;
  • it is unacceptable to place them for a trip outside the tractor cab or other self-propelled equipment, on a trailer designed for cargo;
  • passengers should not be put outside the seats of the bike, in the back of a cargo motorcycle;

The conditions under which it is impossible to carry passengers are also in other points of the traffic rules:

"Gazelle" for transporting people

The Gazelle must be specially equipped to transport people:

Requirements for buses for transporting passengers

The requirements for buses intended for the transport of passengers are as follows:

Rules for the carriage of passengers in intercity buses

The rules for the carriage of passengers in any type of intercity buses presuppose the fulfillment of the following conditions:

  • complete serviceability of the technical condition;
  • availability of a certificate of conformity, waybill from the driver;
  • the opportunity for people to know the route, buy a ticket at the box office or pay for the driver's fare during a stop;

  • do not carry hazardous, foul-smelling contents;

What does "violation of the rules of transportation of passengers on the bus" mean?

Violation of the established rules for the carriage of passengers on the bus is, first of all, ignoring any of the above conditions, but also:

If the motorist has category B, how many people can be transported

If the driver has a category B license, it is possible to carry 8 passengers or less. This is allowed if the number of seats in the transport corresponds to the number of people. When there are more seats, there should still be up to 8 passengers. With fewer seats, you can take as many people as seats.

Is it allowed to transport people on a cargo trailer

Transport people to cargo trailer regardless of the vehicle category is not allowed. There is a restriction in clause 22.8 of the SDA:

It is forbidden to transport people: ... on a cargo trailer, in a caravan trailer, in the back of a cargo motorcycle and outside provided by the design motorcycle seating ...

Is it allowed to transport people in the towing vehicle

The transportation of people in the towing vehicle is not prohibited by any rules, which means it is allowed (if we are not talking about the partial loading method). Is it possible to transport people in a towed vehicle

It is forbidden to transport people in a towed vehicle. There is clause 20.2 of the SDA:

When towing on a flexible or rigid hitch, it is prohibited to transport people in a towed bus, trolleybus and in the body of a towed truck, and when towing by partial loading, it is prohibited to find people in the cab or body of the towed vehicle, as well as in the body of the towing vehicle.

There are no exceptions to it.

Is it allowed to transport workers on platforms of electric cars

The transportation of factory workers on electric vehicle platforms is not permitted. This device exists only for cargo, it does not have sides. How the traffic police inspector will punish for an extra passenger

The need to transport everyone who wants to travel often pushes drivers to put more people in the car than they can fit. They will be punished regardless of what kind of transport is used. It is imposed under article 12.23 of the Administrative Code.

By car

Extra passengers can be penalized in two cases:

  • There are more of them in the cabin than it should be according to the characteristics of the vehicle. Section 1 of the above article works here, that is, the inspector will issue a fine of 500 rubles.
  • One or more people are outside the cabin in violation of the rules. Sometimes traffic police officers find them in the trunk or other places where there are no appropriate conditions. In this case, Section 2 of Article 12.23 works:

Transportation of people outside the cab of the car (except for cases permitted by the Rules of the road), tractor, other self-propelled machines, on a cargo vehicle, in a caravan trailer, in the body of a cargo motorcycle or outside the seats provided for by the design of the motorcycle, entails the imposition administrative fine in the amount of one thousand rubles.

If both parts of the law are violated, then the fines are not absorbed, but added up. That is, the driver will pay 1500 rubles. There is one positive point in the situation - the size of the fine does not increase depending on the number of extra passengers.

On a motorcycle

If the transportation of an extra person in a comfortable car can somehow be understood, then in a situation with a motorcycle it is more and more serious and dangerous. Therefore, the punishment for this offense is imposed under Part 2 of Article 12.23. This is a fine of 1000 rubles.

The same threatens drivers who put a person in the back of a cargo motorcycle. If there are several passengers, the payment amount remains fixed.

By minibus

Excessive number of people in the minibus is punished under the same article 12.23. But there may be nuances here:

  • if one or more adults are in the cabin extra people, the driver will pay 500 rubles. on part 1 of article;
  • if this is a child, the fine for him rises to 3,000 rubles, for an official - up to 25,000 rubles, the legal one will pay 100,000 rubles. in accordance with section 3 of article 12.23 of the Administrative Code.

The last point is applied quite justifiably. After all, if the child did not have enough space in the minibus, there is no restraining device for him / her. And this is a direct violation of the rules, which exposes the life of a little person to increased danger.

If children are being taken

The requirements for the carriage of young citizens are even more stringent than for adults. Therefore, the punishment is much stricter:

  • fine 3000 rub. for the driver, 25,000 p. for an official, up to 100,000 rubles. for legal, if children are transported contrary to the rules (part 3 of article 12.23);
  • the same sanctions for violations during an organized trip (section 4 of article 12.23);
  • 5000 RUB from the driver or deprivation of VU for 4 - 6 months, 50,000 rubles. from an official, 200,000 rubles. from legal (part 5 of article 12.23).

The last section of the law also provides for substantial amounts of payments:

Violation of the requirements for the carriage of children established by the Rules organized transportation groups of children by buses, except for the cases provided for by parts 4 and 5 of this article, shall entail the imposition of an administrative fine on officials in the amount of twenty-five thousand rubles; for legal entities - one hundred thousand rubles.

Penalty for transporting 5 passengers

A fine for transporting 5 passengers in a car is imposed if the equipment is designed for 4 or fewer people, according to part 1 of article 12.23:

Violation of the rules for the transportation of people, with the exception of the cases provided for by parts 2-6 of this article, shall entail the imposition of an administrative fine in the amount of five hundred rubles.

And another sanction may wait for the fact that an extra passenger is not fastened. This is 1000 rubles. under Article 12.6 of the Administrative Code.

Penalty for overloading passengers

A fine for overloading passengers in a car can also be issued only under Article 12.23 - 500 rubles, if there are extra ones among them. But with the total number of people corresponding to the number of seats, there should be no punishment. Moreover, Article 12.21 is inapplicable here. After all, it concerns only cargo, but not people.

Penalty for transporting people in a cargo van

Penalty for transporting people unsuitable for this cargo van imposed under Part 2 of Article 12.23:

Transportation of people outside the cab of a car (except for cases permitted by the Road Traffic Regulations), a tractor, other self-propelled vehicles, on a cargo trailer, in a caravan, in the back of a cargo motorcycle or outside the seats provided for by the design of a motorcycle shall entail the imposition of an administrative fine in the amount of one thousand rubles.

But if we are talking about accompanying property for whom the seats are equipped, the sanction is not applied. In this case, there should be no more than two people, the same number of chairs.

Penalty for transporting people in the trunk

A fine for transporting people in a trunk intended for another purpose is also imposed under Part 2 of Article 12.23, that is, the driver will pay 1000 rubles. He will also face a trial as to whether a person voluntarily ended up in this compartment. And if it turns out that no, the criminal article also applies.

Penalty for standing passengers in a fixed-route taxi

Penalty from the driver for standing passengers found in shuttle taxi, will amount to 500 rubles. Here, part 1 of article 12.23 is applied, not part 2, because people are in the passenger compartment, not outside it. But this is still a violation, since according to the rules, there are no standing places in the minibus. This is not possible due to its technical characteristics.

Penalty for transporting people in the back of a Gazelle

The fine for transporting people in the back of a Gazelle not equipped for this is 500 rubles. Part 2 of article 12.23 of the Administrative Code works here. If the body has seats for accompanying the cargo, they can be there. The driver should not be punished for the presence of employees. It will also be possible to avoid sanctions if the car is completely converted for passengers, and the driver has a category C or D. But you can only take adults, not children.

Penalty for illegal transportation of passengers

For those who are professionally involved in the transportation of people, stricter sanctions are also possible in case of violations. One of them is illegal transportation, that is, the lack of permission for this type of activity. The punishment for it is regulated by section 2.1 of article 12.3 of the Administrative Code. The driver will have to pay 5000 rubles for the absence of a document.

Penalty for incorrect transportation of passengers

A fine on the driver for incorrect transportation of passengers is imposed in accordance with
from article 12.23 of the Administrative Code. For general violations, Part 1 is used, this is 500 rubles. in favor of the state.

This section of the law works in the overwhelming majority of cases when it comes to personal cars. For example, if the number of people in the cabin exceeds the number of seats intended for them. That is, the fine for transporting passengers without a seat is 500 rubles.

Improper transportation of people also means not wearing seat belts. For the fact that the passenger did not fasten his seatbelt, not only him will be punished under Part 1 of Article 12.29 Code of Administrative Offenses with a fine 500 rubles, but also a driver. The latter is threatened with the application of Article 12.6 of the Code, that is, the payment of 1000 rubles. The penalty for improper transportation of passengers on a motorcycle will be similar. The sanction will be applied to the bike driver if they are not wearing protective helmets.

There is also a fine for a passenger in the trunk - 1000 rubles. It is imposed under Part 2 of Article 12.23 of the Administrative Code.

Punishment for transporting people in the back

Putting passengers in the body of a car, if it is not adapted for this, is even more dangerous than filling the cabin or interior with them. And therefore the punishment for this is provided for in part 2 of Article 12.23. This is a fine of 1000 rubles. It doesn't grow because of the number of people in the back. But this does not negate the need to install seats there.

It is possible if:

  • install and firmly fix chairs or benches at a distance of 30-50 cm from the floor;
  • make bumpers at least 30 cm high from the seats;
  • provide communication between passengers and the driver using a button that beeps;
  • arrange an awning and lighting for transported people.

It is allowed to drive such vehicles only with category C or D. All technical changes must be approved by experts and registered with the traffic police.

Changes that drivers can expect

Fines for excessive numbers of people in a car and placing them for transportation there,
where it is inconvenient and dangerous for a person to travel, are small. And there are many cases when they were injured or died because of this, getting into an accident.

Therefore, legislators are increasingly talking about the need to increase penalties under the aforementioned articles of the Code of Administrative Offenses. A proposal has already been made to increase compulsory payments from those who are seen on illegal transportation (there are many accidents involving such motorists).

It is possible that article 12.3 will undergo changes, and the taxi driver will pay no longer 5,000 rubles without permission, but 20,000 - 30,000 rubles. It is proposed to charge legal entities with a fine of 300,000 - 500,000 rubles.

So far, these changes are only in the plans. But motorists need to follow the law. Recently, penalties have been toughened under many articles of the Administrative Code. It is possible that the fines will increase both for extra passengers and for other violations related to the transportation of people.

Sometimes a person is ready to suffer inconvenience in a car or bus, just to get to the right place faster. But the driver shouldn't use it. What regulations govern

All norms for the proper transportation of passengers in the field of highway infrastructure are regulated directly by those legislative acts that speak more about the Rules for ensuring the safety of passengers by land transport.

  1. The Administrative and Legal Code (hereinafter referred to as the Code of Administrative Offenses of the Russian Federation) reveals the meaning of the legislative act in terms of violations in the transportation of people.

Since there is no separate normative act at the level of federal laws that would separate fines (and other penalties) for non-compliance with the Rules for Passenger Transportation, the State Duma Russian Federation is currently considering Project # 902547-6.

He visited the last edition on October 14, 2018 and claims to serve as an addition to the Rules, which were approved by Order of the Ministry of Transport of the Russian Federation No. 7 dated January 15, 2018.

This bill proposes to introduce separate fines for violations such as:

  • ignorance by drivers and passengers general requirements transportation;
  • detected offenses in special conditions transportation of passengers (children, disabled people, etc.);
  • cases when the driver is allowed to drive passenger vehicles without proper instruction, which is provided for by the Rules from the Ministry of Transport of Russia;

Amounts of fines for the carriage of passengers in excess of the norm

All norms of fines that are supposed to be paid in case of violations detected and recorded by the road patrol are determined in accordance with the administrative legal norm - Art. 12.23 of the Administrative Code of the Russian Federation.

It should be noted that if the carrier is a company or transport company, which conducts its business illegally (without a certificate of state registration), then she will pay all fines as a legal entity (the last paragraph of Article 12.23 of the Administrative Code).
